Ok long story short ,

My wife and step daughter arrived on July 20 2012, Had to wait to file for AOS about 6 months but got their social security card's, And we got married before The I-94 expired. We have called and keep getting the same thing wait 6 months then call back if nothing well it's been almost a year and will be on July 20th of this year. her work and travel card expired on the 12th of this month as well as her Texas I.D card. passport is expired as well.we just had a baby girl may 13th of this year. What can we do? who can we call and what are we to say? any help will be greatly appreciated.

Why did you let all of her ID's expire??? It's going to be a real pain in the butt to renew them now!

Agree with the one who replied above...if you're having issues dealing with USCIS...go straight to your Congressman and/or Senator...go on line and look up who your congressman and senator is for your local area...then, write them a letter explaining all that has happened. Better yet, see if you can meet with your local Congressman at his/her office. You will have to fill out a couple of "release" forms so that they can legally access information about your case.

File new I-765s and I-131s for new EADs and APs. USCIS recommends you file for renewals 120 days before your current documents would expire, so you're behind in that.

File for a replacement passport.

As stated above, contact one of your congressional representatives to find out what is happening with the I-485s.

EAD and AP are renewable, and still have the fees waived when you file to renew them.

Some have had to wait over a year when having the interview waived, so perhaps that is the case for you, and you are stuck in that backlog.

ok here's the update we just go a letter saying we have a interview on the 31st of this month (July) I thought they waived it being we hadn't heard anything in over a year? being everything is expired are we going to have trouble? we was thinking we'd already would have had green cards by now. as for the passport we don't plan on leaving out of the country for at least 2 more years but when they come close to Texas again we are still going to renew them and the ap and work card well my wife just had a baby 2 months ago so she will not be working and if she does we should have a green card by then , my step daughter is only 9 why does she need one anyways right. No problem even if they are expired. Hakuna matata. Not sure about passport's validity though.

You need a bit more than a baby, a marriage certificate and tx ID to prove your relationship.

No point renewing the texas ID or passport before the interview. The new documents may not arrive before the 31st. I know they accept expired passports as ID for biometrics so I don't see these being a problem for the interview. I hope you have joint tax returns, insurance and at least 1 joint account to further prove your relationship. There is none stronger than a child together though. Please remember to take the child's birth certificate along as well. All the best.
