If you haven't noticed by now, lawyers will say anything as long as their billable hours clock keeps running....a pending separation is going to give USCIS pause...pure and simple...it won't be easy, and anything your lawyer says, whether orally or in writing is positively worthless. USCIS will not take the word of some immigration attorney...their word has less value than two week old toilet paper. So, the burden of proof will fall on you and your soon-to-be ex-spouse...period....your lawyer will keep invoicing you, however, and thus, he (or she) could care less how long this takes...every hour is another $300 or so to the lawyer, no matter what the outcome (a fact that I'm sure the lawyer forgot to mention)...

Lawyers are under a lot of ethical obligations when representing clients. If you were so unlucky as to come across some who are the shame of the profession, it does not entitle you to badmouth any and all attorneys.

EvaMariaSoto, follow the advice of your attorney if you trust him/her. If you have any reasons to doubt that he/she is acting in your interests or is not doing enough you may want to get a second opinion. While filling out immigration forms is not brain surgery, you want the best advice when your case is complex and in a somewhat grey area.
