We didn't file this form within 90 days of our arrival but I know you can submit this with adjustment of status under who may file though is where I run into some confusion it says if you file with 90 days you use a 6 if not you use c 9 ( I don't see the description of that) can someone clarify

If you file for the EAD before filing for AOS, then you would use category (a )(6 ) and need to pay the form fee of $380. It would expire when your I-94 does, and it cannot be renewed. When filed with a pending I-485, the form fee is waived(as is the I-131), you use (c )(9 ) and it will be valid for a year and is renewable, still for free, if needed.

6. Family-Based Nonimmigrant Categories

A. K-1 Nonimmigrant Fiance(e) of U.S. Citizen or K-2
Dependent--(a)(6).
File Form I-765 if you are filing
within 90 days from the date of entry. This EAD
cannot be renewed. Any EAD application other than
for a replacement must be based on your pending
application for adjustment under (c )(9).

7. EAD Applicants Who Have Filed for Adjustment of
Status

A. Adjustment Applicant--(c )(9). File Form I-765 with a
copy of the receipt notice or other evidence that your
Form I-485, Application for Permanent Residence or
Adjust Status, is pending. You may file Form I-765
together with your Form I-485.
