I'm just giving you the opportunity to back up your opinions, which you seem to think are facts with some actual factual knowledge even if its as little as a simple legal definition, which could be easily found on google. You make big claims, VAWA is a failure, no due process in courts, rampant fraud, but not one sliver of anything to back it up other than taking your word for it, because you've sat in the back of "a" courtroom and watched.

anyone who feels the need to respond to others by way of insult or by demeaning them, just doesn't have a strong enough argument or the knowledge to put forth otherwise. no point arguing with them or fueling their need for attention by responding to their (baseless) jibes. :)

You continue with writing skills that far surpass your reading ability. Intentionally, probably.

You clearly have a very deeply vested interest in attacking opponents of the matter. Nothing more.

Let's get back on topic folks.

There is no doubt VAWA fraud occurs, but the system is designed for leniency to protect women (and some men). And it seems to work statistically.

What is not addressed by the government or anyone really is what is done to protect the system from fraud and to prosecute for fraud and to put fraudsters in to removal proceedings.

Some have asked for proof. I am one source of proof as a victim of fraud.

The second arguments relate to false DV claims and restraining orders etc. Yes those occur too, and again women tend to have the upper hand here.

However, women or men falsely accused of DV better have lots of evidence and a damn good attorney, because unlike VAWA these cases may go on the accused personal record and may lead to jail or prison time. I know a guy in jail now who's ex-wife got jealous and called the police and claimed he sexually abused the kids. The guy hadn't even seen the kids! He'll be going up the river for a few years.

As for TRO's those are filed in local courts, reviewed by a judge, if granted then served by an officer of the law upon the defendant, who then has an opportunity to fight it in court or not.

While I agree little with what you say and would argue The Law is being used in completely illegal, misguided and destructive ways, as the old saying goes, I can fight to the death your right to say it. That's what makes this country great.

After reviewing several of your posts you seem to be one of the most mis-informed and illogically compartmentalized thinkers I've ever encountered on VJ.

The purpose of the thread is to acknowledge whereas VAWA is necessary and good for some, it is indeed taken advantage of by fraudsters simply seeking benefits of LPR status in the USA with often sociopathic disregard for the victims they leave in their wake for the sake of their own selfishness.

Based on the perspective of the discussion area in general, I can't see how you could come to any other conclusion. I can only suggest my observations and data set are merely more unique to and differ widely than the masses here. There are even some here who earn a living facilitating relief under the law and they posess their own limited and mis-guided perspective in support of that at any cost.

In the end, the law and it's application remain very controversial.

The Law is controversial for you my friend, because I never heard about "the Vawa controversy" in any Court room, or even when participating in the USCIS stakeholder meetings.You are entitled to your own opinion.But you are not entitled to your own facts.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
