tax return w2 question for 485

Well i submitted my paperwork a few weeks ago. Got an RFE int he mall yesterday regarding my W2s. The problem is i dont have a w2 for the past 2 years as i was working for a foreign company. I supplied my tax returns, i can file taxes with this for 2555 foreing income credit. Anyone know if this will be good enough? I am currently working in the states so this years tax return should be no problem at all. SO i resubmitted my tax return along iwht that foreing tax income, i didnt sent that foreing income orriginally, and a letter stating that that for 2555 foreign income tax was submitted in liu of a w2 as i didnt receive one. anyone have any ideas if this will be enough. i also submitted bank letter, letter from current employer. The way i look at it if its not enough i will have my new tax return for 06 pretty shortly then send that with next rfe but hoping i wont get another. any comments please.

The only thing you can do is respond the best way you can. You cannot make up documents for ones that do not exist. You explained the best you could. Now only time will tell if they understand.

Hi jpine,

Interested in your post as my foreign income situation is similar, however, I'm not eligible for the foreign income exclusion/deduction (2555) that you were. I too don't have a W2 for my foreign earnings as I was working for a foreign entity in Vietnam. We have not filed AOS yet, but after reading your post, I will include a statement indicating the reason for the absence of a W2 for that tax return. I hope this will be sufficient.

If you get any further feedback regarding your RFE, would you mind posting again on this thread?
