Hello all,

I had a minor concern about the situation I was in and really wanted to get prepared for the hopefully upcoming soon interview.

My parents-in-law adjusted their status through my USC spouse several years ago. My father-in-law later gave up on his green card, while my mother-in-law kept it. They are currently residing in their home countries, but in order to maintain the green card, my mother-in-law has been making constant visits back to US.

Therefore in I-864, although my mother-in-law does not actually live with us we had to put 3 as our household size since the form required to count additional person whomever my spouse had to previously sponsor to adjust the status. (Part. 5 of the form)

When it comes to an interview, do you think that an IO could be questioning about my spouse's previous sponsoring history? I'm afraid to answer where my parents-in-law currently live because my mother-in-law spends more time in her own country than she does in the U.S. I believe IOs are smart enough to know that the household size number put in I-864 would not necessarily represent the actual number of people residing with us... but oh well. I guess I'm just being a bit too nervous about it.

Any comments would be much appreciated!

Great question. You're right to be worried. Parents' Travel Patterns seem spurious,

but

you are a spouse, not a parent. There's a rumour you'll be living with your spouse after the POE for a longish time - at least the IO is hoping that.

Your inlaws history with USCIS has no bearing in your petition; that said; should a question come up directly asking whether mother is living permanently at the household, or how long does the mother spend in the country, you do not want to lie.

^This. A million times this.

USCIS has access to people's travel histories pretty easily. Tell the truth, or it will come back to bite all three of you.

I was not going to lie about it but just got worried if there would be any kind of disadvantage.
