Is renewal of current passport to include married name necessary for NVC?

Hi VJ family,

My husband and I got married in October 2013. Since then, I have been slowly changing out my documents/ accounts/ IDs to reflect my married name. I am yet to do my Driver's Licence and my Passport. Seeing that the Passport is more important, I decided to do that one first. My husband filed our I-130 petition in April and we now await its approval, which going by USCIS snail pace, we are looking at September for NoA 2. In the mean time - and between time - we are going about gathering all the documents that we will be required to submit, once our case is sent to NVC. At the NVC stage, (hopefully with no RFE's) is probably going to be another 4/5 months - January /February 2015 (we are hoping for December :) )

Here's where I'm seeking your expert advice.

I'm currently filling our forms to have my Passport renewed to reflect my married name, which I would then mail to my husband before our case gets to NVC. However, my passport still has about 10 months on it - expires in March 2015. I'm not sure if I would need to travel between now and December. My tourist visa is in there in my maiden name.

Question:

Do I really need to have my Passport renewed at this time in order to send Bio page with married name to NVC? Or I could leave it until about January to get it done, and let the IV process at NVC continue in my maiden name?

I've done some searching, but didn't find anything closely related to my situation. If I have to renew it, I have no problem doing so now. Just don't want to have to do it now if its not detrimental, and since the expiration date is March 2015.

Thanks in advance for any advice.

Feb. 12, 2015: Case Complete with NO checklist! whoot, whoot!

Mar. 25, 2015: Received P4. Interview

April 29,2015: Completed medical examination

May 13, 2015: Interview Date APPROVED :dancing:

May 19, 2015: Received Package

Oct. 22, 2015: Travelled to my new home :) (In order to get IR-1 Green Card) Expiration date on IR-1/CR-1 Visa - Oct. 29, 2015

Nov 10, 2015: Received Social Security Card

Jan 4, 2016: LPR Green Card arrived.

your green will be issued with the name used on the i 130. you could use the maiden name passport until it expires even at nvc. when doing interview your passport must be valid for more than 6 months after interview.

your green will be issued with the name used on the i 130. you could use the maiden name passport until it expires even at nvc. when doing interview your passport must be valid for more than 6 months after interview.

a visa permits travel to us, entrance to us is dictated by uscis. uscis assigns an alien number to the name on the i 130 before visa is contemplated or issued. a maiden name passport and a marriage license suffices for and proves your name(married) for entrance into us once passport is valid.

I was in a similar situation. It took about 3 years after my hubby and i got married before i changed my passport. The paper work we sent to NVC was with the passport i had at the time which didn't have my married name, however once we got the date for my interview i went and renewed the passport and collected it before i did my medical. So once that was done, all the documents that were later turned over to the embassy reflected my married name. Good luck

CBP, Customs and Border Patrol, dictates who can enter the USA. The USCIS does not, but both are part of the Department of Homeland Security. The NVC and the Department of State is who issues the visa. The visa is ALWAYS issued in passport name. If the passport does not have the married name. The visa will not have the married name.

The green card always comes in visa name. Please show me an instance where it has not?

However you can change it after the fact using an I-90 and a $450 fee to change the green card after it's received.

Also in IR1/CR1 cases upon entry the visa is endorsed by the CBP. At this time the visa becomes a temporary green card and is valid for up to 1 year.

As long as the passport has the married name before interview, you should have zero issues and it will not cost you anything extra.

Immigration officer is also a custom and border agent and an immigration and custom enforcement agent. thats the job title in uscis. CPB IS A PART OF USCIS. Did you do the CR1/IR1 process? According to your timeline and signature and profile you did an adjustment of status which is entirely different.

USCIS and CBP are not the same, but they are both part of the DHS.
