I have been living in the states for 6 years came here on a F-1 visa just graduated college in 2013 and is now currently on OPT. Been married for over 8 months been together over three years but we are now ready to file for the green card. We have a 9 month son as well.I have a few questions:what is proof of bona fide marriage? We both filed our taxes last year does that count? Does our son birth certificate works? We rent from our parents so we have no proof there of property.

Do we both fill out an affidavit of sponsorship or just my spouse?

I am filling for an extension to my OPT since I am a STEM grad would I still fill out a i-765?

1. Marriage Certificate, Birth Certificate, Tax Return Transcripts, bills, bank statements, insurances, car titles are bona fide marriage proofs. An affidavit of communal residence from your in-laws will be helpful for joint residence.

2. Your spouse will file I-864 for you. You can self sponsor but it is complicated and I don't know much so other members can guide you out.

3. If you file AOS concurrently, a work permit will be granted for you which is different from OPT STEM EAD.

do your driver licenses list the shared address? if so that would be good :)

joint taxes definitely carry some weight, the IO who interviewed us was very interested in our joint tax return.
