Thanks, guys! I got approved, as you can see here: http://www.visajourney.com/forums/index.php?showtopic=5216

The fact that I had come here as an F-1 was not a problem. Since I had met my husband before coming here (even though we were nowhere near having a relationship at the time), she did ask whether my choosing to come to Seattle had anything to do with him. I answered no, I came to Seattle because I had visited university campuses here and liked the schools. That was fine with her. Oh, and also, the fact that I am still going to school, and haven't stopped attending in spite of being married also seemed to sit well with her. She didn't ask any more questions about my F-1 status, nor did she ask to see any paperwork related to that.

Good luck to you all!

hi there,

i'm F1 too. this is the right place for you to look. Like kc456 said, you file 130(by your husband), 485, EAD and AP. if your district office is fast and you don't have immediate travel plan, you can leave the AP and save some money.

my school recommended me to keep F1 status until i get my GC. it is tricky to keep dual status (F1 and AOS) at the same time. it is best for you to consult your university international office. different schools have different policies.

beside the AP, EAD might also give you problem too. F1 authorize you to work 20 hours/week on compus. EAD give you the right to work unlimited on compus or off compus. Just to be on the causious side, i've been keeping my 20 hours on compus job since i applied.

When I crossed back into the US from Canada, at my point of entry they told me that you cant keep both an F1 and AOS. Like he said you cant keep an non immigrant visa and be an immigrant at the same time. Personally I have never found the school advisors to be any help, they are not really well versed in all the immigration laws.
