Hi all :D ,

Seems to me that a lot of AOS topics/timelines are for K1.

Am I in the wrong place? If so, where is the AOS topics for F1 students? :help:

FYI: I am F1 (OPT), got married last Oct. We are planning to apply for AOS this month (Mar 2006).

It will be nice if I can talk to the ppl who's in the similar situation...

No you're not in the wrong place...

The majority of members of this forum who are adjustingt their status have been through the process of obtaining one of the marriage based visas (K-1, k-3, CR-1, DCF etc..). There are number of members however who arrived in the US on other visas (eg. tourist / student etc..) and are now going through the process of adjusting their status from those. I am not familiar with the process of applying for a green card from an F-1 visa so wouldn't really be able to comment on the similarities / differences between the processes. I'm sure that someone will be able to give you some more information pertaining specifically to AOS from and F-1.

Timeline Summary

11/30/2007 - I-751 Mailed to Nebraska

12/28/2007 - NOA Received (application has been forwarded to California)

01/09/2008 - Biometrics taken in St. Louis

03/27/2008 - I-751 Approved, 10 Yr Greencard in the mail !!

12/20/2016 - N-400 mailed to Phoenix lockbox

01/17/2017 - NOA Received

01/25/2017 - Attended biometrics in St. Louis

09/29/2017 - Received I-797C notice dated 09/27/17.  Interview Scheduled for November 6th @ 8am

11/06/2017 - N400 interview in St. Louis.  Approved !!:jest:

02/05/2018 - Notice of Oath Ceremony date received.  March 1st, 2018 @ 8.30am

They are definitely out here. :) There's at least one or two. You should be able to search by what they filed for, but I'm afraid I'm not very certain on how to do that. ^^;

26 January 2005 - Entered US as visitor from Canada.
16 May 2005 - Assembled health package, W2s.
27 June 2005 - Sent package off to Chicago lockbox.
28 June 2005 - Package received at Chicago lockbox.
11 July 2005 - RFE: cheques inappropriately placed.
18 July 2005 - NOA 1: I-485, I-131, I-765 received!
19 July 2005 - NOA 1: I-130 received!
24 August 2005 - Biometrics appointment (Naperville, IL).
25 August 2005 - AOS touched.
29 August 2005 - AP, EAD, I-485 touched.
15 September 2005 - AP and EAD approved!
03 February 2006 - SSN arrives (150 days later)
27 February 2006 - NOA 2: Interview for 27 April!!
27 April 2006 - AOS Interview, approved after 10 minutes!
19 May 2006 - 2 year conditional green card.

It’s pretty much the same process. The difference is that your USC spouse needs to file I-130 (Petition for Alien Relative) concurrently with I-485/EAD/AP. The I-130 and I-485 will be adjudicated together, so there is not extra waiting. Another difference is that you will need a full medical exam by a civil surgeon, not just the immunization supplement. If you travel internationally after marriage, them using F1 to come back to the US may be tricky; I’d suggest you consult with the foreign student office or look this information up specifically so that there are no unpleasant surprises while entering the US. Other that that, you’ll be going through the same steps so this it the right forum for you.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

11/20/09 Called FBI-Prints were sent back to USCIS same day.

12/03/09 Rec'd email from USCIS that the RFE was a mistake.

12/04/09 Rec'd email from USCIS saying that I have been transferred for an interview.

12/07/09 Rec'd letter for interview on 1/11/10 @11am in Fairfax, VA.

01/11/10 Interview completed. Passed test decision can't be made.

03/02/10 Contacted Senator's office...No reply yet!

03/04/10 Senator office called says can take up to 120 days.

04/12/10 Service request filed.

05/12/10 Contacted Senator's office again.

05/12/10 Told over the phone that I was approved. Believe it when I see it!

06/04/10 Senators office tells me the adjudicator who interviewed me thinks I have a criminal record. Send out all paper work showing no criminal record.

06/08/10 Leave for Canada

06/09/10 Get RCMP certificate showing no criminal record. Fax off to senators office.

06/23/10 Approved for Citizenship

06/24/10 USCIS contacts Senators office

06/28/10 Find out that I have been approved for citizenship and they are just waiting to schedule my oath.

07/12/10 Put in line for oath ceremony....wonder how long that will be!

08/18/10 Called USCIS confirmed they sent oath letter for 09/17/2010 at 9am.

09/17/10 Oath ceremony at 9am..... US Citizen!!!! Applied for passport.

I am on the F1, I guess no more because I filed for AOS.

It's like any other visa, I think they don't care what you're changing from,

once you file for the AOS I think the other visa disappears anyway.

March 8, 2006 - EAD received

March 29, 2006 - interview notice received - May 31, 2006

May 31, 2006 - Successful interview!!! Approved

June 12, 2006 - Green card received

Feb 28, 2008 - will be sending removal of conditions docs.

Correct.. once you file the I-130/I-485, your status will no longer be a F-1, but as an adjustment applicant. You will not be able to leave the US without Advanced Parole.

Other than that, you can continue on as if there was nothing different...

F1 here also

MARRIED MAY 2003

Submitted AOS July 2003

Received NOA August 2004

Several EADs in the process

Interview July 2005 (waiting on approval, & waiting & waiting *sigh* are we there yet?)

Submitted renewal of 3rd EAD Sept 05

Biometrics for EAD renewal Oct 26th (3 hour drive) even though there is an ASC 15 mins from my house... no appts available there :(

Oct 27th - Sent strong letter to District Director requesting a decision*** Hope this works :(

October 29th - Sent letter to congressman for help.

AOS Approved - Email Notice Nov 17th it's about bloody time... *sipping on my Guinness*

Nov 18th --- Welcome to America Letter received...

Nov 19th 10 year Green Card received in the mail.... Good bye USCIS .. until Citizenship

So nice to get to see other AOS timeline from F1... (really gives me hope!)

I'm putting all the forms together now, and my Med Ex is scheduled next week!

Some little questions might pop up later on as I'm filling all those paper works-

but now I know where to come back and ask! :thumbs: YAY!

I'm also an F1, and have my interview tomorrow. I will let you know how it goes!
