My children and my husband went to the Embassy for our interview last Monday. The questions were: how long we've been married, where did we get married, our jobs, how long we lived abroad. The CO didn't ask for more evidence nor did she look at our papers. It appeared to us that they had reviewed our documents prior to our interview. My husband was asked if he has a co-sponsor and he told the CO that no, he doesn't have and explained that he's making double of what was stated in his income tax. He's only been working for a year with his current company, that's why it appeared that he doesn't meet the required income for all of us. He explained this to the CO. So the CO told him that it's okay not to have a co-sponsor and that she will give us the visa but my husband must submit the last three months pay stubs. She just wants proof of his current income. She told us to go and wait for our names to be called again from the other window. She didn't give us any paper.

In the next window, the lady told us that as per the CO, we need to submit the pay stubs and that's when they can issue the visa. She told us that she's sending an email to my husband for the instructions and send the pay stubs using 2Go courier service.

After that, we were asked to give the white papers we filled out to the next window. The white paper is for where to deliver our passports.

We already submitted the pay stubs the next day and including the printed email for their reference.

We are still waiting the response from them.

Has anybody here experienced the same thing? Would it take very long before we hear from them? My husband already left for the US and can't wait because of work.

Thats a terrible story-- So Sorry to hear that- I do know that it is the FINAL decision of the Consular officer to approve the paperwork- I am interested in what the AOS said to begin with? did you submit proof of current income to the NVC?

Thats a terrible story-- So Sorry to hear that- I do know that it is the FINAL decision of the Consular officer to approve the paperwork- I am interested in what the AOS said to begin with? did you submit proof of current income to the NVC?

It's not really that terrible for us, unless they find the additional pay stubs insufficient to convince them that my husband is capable of supporting us. The CO is making it easier for us by asking for some additional pay stubs rather than we get a co-sponsor. As she said during the interview that she will give us the visa, but my husband must send first some additional pay stubs. We are only worried how long would that take for them to process it or if there will be some additional paperwork.

Yes, we submitted proof of income to the NVC, even pay stubs. But apparently, the embassy wants more.

We really hope everything turns out fine.

there are lots of things to present for that.

one of them is 'current annual income' on the I-864.

Sorry he did not give that to you.

But it's good the Vice-Consul is allowing him to present it next - it's not any Visa Denial (at the moment) - they simply cannot issue the Visa because the case is not documentarily qualified ..

Once the case is documentarily qualified - visa should be issued.

FWIW - 'current annual income' is on the I-864 section and in the instructions. Seems your spouse missed that part, in it's entirety.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

We originally submitted the current annual income and they sent all the papers back because they said we HAD to put whatever was on the tax transcript. The tax transcript only reflected 6 months of employment. Our original submissions were returned to us, as a result of the discrepancy between what my husband makes and what the tax transcript shows he made. NVC told us specifically that the number in the current annual income MUST match the tax transcript. FWIW, he did put the wrong numbers in a whole lot of spots. Then he sat on the phone with a NVC rep for an hour while he redid the entire form to their satisfaction and according to the reps advice. At any rate, my husband can plainly see from the documentation he provided, that his current annual income is twice what the form reflects. But the form reflects the number the NVC rep told him he had to write.

'current annual income'

is never 'tax data'

as 'tax data'

is for prior years income.

CURRENT means this year, 2014 - and usually is shown/proven by (pick 1 or more)

1. pay stubs

2. a letter from an employer

3. a letter from a CPA who authenticated this income

Sorry - he got it wrong prior and the Vice-Consul adjudicated the case based on what was in the casefile. Current Annual Income was missing.

Is two types of income to show on the I-864 -

PRIOR (via tax records) and

CURRENT.

a verbal disclosure on interview day by the Petitioner will never suffice - must to provide paper , stuff from my list.

I don't know how else to mention this to you - your husband missed this, totally, on the I-864 during NVC intake and never got it corrected. It reads like he tried, but not submit the proper stuff on the checklist letter response at NVC.

Oh great news! I was able to check our case status today. I just found out that they already issued the visas and will be delivered in 7-10 working days! They got the pay stubs on Wednesday and updated our status on Friday.


That was fast! Everything's good then!


The CO kept her word that she will give us the visas and we just need to send the additional pay stubs to them.


By the way, we submitted his employment letter and some 2014 pay stubs as well, to show his CURRENT income, only they wanted more.

PS... for others who might experience the same, they didn't give us any 221g form but they emailed us what to do. It's case to case basis... Good luck to all!
