After sending the i-130 + i-485, can I apply for driver's license during the processing? After how long? Receiving notice of action or what?

08/08/2014 - Sent i-130, i-485, i-131, i-765 to Chicago Lockbox (day 00)

08/11/2014 - USCIS received package. (day 03)

08/18/2014 - NOA Hard Copy for i-485, i-130, I-131 and i-765 (day 10)

08/22/2014 - Biometrics Appoiment Notice for 09/03/2014 (day 14)

09/03/2014 - Biometrics done (day 26)

11/06/2014 - i-485 changed to Testing and Interview (day 85)

11/10/2014 - EAD Approved (day 89)

11/10/2014 - Interview scheduled to 12/11/2014

11/18/2014 - EAD in hands

12/11/2014 - Interview - Basically approved on the spot. Received text messages saying card/document production 30 minutes later

drivers license issuance governed by each state.

what does your state website say about issuing a drivers license?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

In the majority of states including mine CA, once you receive your EAD you can apply for your social security number ( if you do not have one already ) . Most states need your SSN and your EAD for a driver License application.

I see above you mentioned the I-130 and I-485, be sure to apply for your I-765 (EAD) at the same time, it is no additional cost and you will gave it within 90 days

05/09/2014 - ( day 79 ) - Applied for SSN

05/15/2014 - ( day 85 ) - SSN Arrived :)

05/19/2014 - ( day 89 ) - passed CA driving test

05/27/2014 - ( day 97 ) - CA driving License arrived :)

06/04/2014 - (day 105 ) - Case updated. Interview set for July 9th 2014

07/05/2014 - (day 136) - Interview date changed by field office ? New date July 17th

07/17/2014- (day 149) - Interview...Approved on the spot 10 year card !!!!!! :)

07/23/2014 - (day 154) - Welcome letter and I485 approval letter received

07/24/2014 - (day 156) - GREEN CARD IN HAND (10 year)

The state here is wisconsin. I didn't understand very well. There are two kinds of driver's license here. One is considered "Real ID " and the other one probably is not valid as identification.

For the Real ID one they ask for either:

  • Valid I-551, permanent resident card (issued by the Department of Homeland Security/U.S. citizenship and immigration services). Non-expiring I-551 (issued 1977-1989) cards are acceptable.
  • U.S. Certificate of Naturalization (federal form N-550).
  • Certificate of U.S. Citizenship (federal form N-560).
  • Employment Authorization Document.
  • Unexpired foreign passport with a valid unexpired U.S. visa affixed accompanied by the approved I-94 form documenting the applicants most recent admittance into the U.S.

For the second kind they ask for either:

  • Valid Temporary Resident ID card (federal form I-688).
  • Valid employment authorization document (federal form I-688B or I-766).
  • Valid refugee travel document (federal form I-571).
  • Notice of Action (federal form I-797). Document must provide conclusive proof of legal presence and be accompanied by other supporting documentation.

Now here appear some doubts. For the Real ID one, they say that "Employment Authorization Document" is enough, so I would have to wait for the EAD for the real one

Anyway, after the notice of action i-797, apparently I can get the non-ID one (probably I can't travel into planes and don't use as any form of ID, at the bars, etc)

Any idea if my thoughts are correct or not?

Another thing. What would be the difference between the EAD listed on the REAL ID one, and the "form i-766" listed on the "non-official" one?

Are you sure you're not confusing the Drivers license and the State identification card? Make sure you look into what you end up applying for because the State ID is not for driving. It's just a legal ID for banking,drinking etc.

8/28/2014 received email that EAD has been approved...Will have interview before EAD is mailed though LOL!

9/04/2014 AOS Interview in Boston. Approved!!!! (day 83)

9/6/2014 EAD delivered

9/11/2014 GC delivered
