Hi VisaJourney members,

Please help me to solve the issue:

I have filed IR5 petition for parents of US Citizen.

My Father was not issued a birth certificate in India due to my grandmother failed to register his birth in registry. My father does have Indian Passport, PAN, and Driver License. Indian government issued all the documents based on the affidavit of birth.

I have sent the original Notarized affidavit of the birth to NVC but it does not want to acknowledge it as a Birth Certificate and wants only the original birth certificate which Indian Government do not want to issue.

NVC also sent me checklist to file new AOS coz I missed amount on 1 line. I sent them new AOS form but it says NVC is still waiting for the AOS to make decision on the petition. I have checked with USPS track and confirm that they had delivered the package on time to NVC the next day when i sent it.

So the question is what are my options to convene them about the birth certificate?

and how to make them find my AOS documents?

Please help me. This petition is in its last stage. And I dont want to make any more mistake here. Or THE Lawyer is the only answer in this case?

According to me, the 10th standard certificate of your father along with a letter from municipal corporation that the birth was not registered would serve the purpose of birth certificate. I have read this in US consulate new Delhi website and even my neighbors did the same thing(they were sponsored by their daughter and they told us that nvc asked for a letter from MC along with secondary evidence like matric certificate)

I just had my interview on 20th June. They refused to take 10th marksheet as proof. They accepted non availability certificate from local municipal corporation and affidavit of elder relatives. Try to see if any elder relative can give affidavit.
