I-130 for unmarried daughter over 21

Hi

Has anybody here filed for an unmarried child over 21? All I seem to be seeing are applications for minors and parents.

My daughter didn't want to come with me at the time I got married, although she was over 21 at the time. I just wish she had decided to at least apply then, as I know she has a long wait now.

Can somebody explain how this works for her?

I am a US Citizen now.

The total waiting time for her will be 7 YEARS provided she stays unmarried.

You file the i130.

You should petition for her now and sit back and wait. She would be in FB1 category. Be aware that if she gets married she moves into another category and the wait will likely be longer (unless she married a USC!).

FB1 Petitions submitted before March 2007 are currently being processed. The wait for your daughter may be longer, or it may be shorter. There is no way to predict future movement; some months it speeds up, some months it slows down, some months it's doesn't move at all.

Actually if she married while her mother in still an LPR the petition is dead. And marriage to a USC or LPR requires a new/different petition

This will not be over quickly. You will not enjoy this.

Thanks for the info guys. I knew it would be a long wait. With hindsight we should have filed when I moved here in 2007. :clock:

But we've applied for her anyway, if her situation changes before then, so be it. We still get to see her plenty of times so it's all good.

How comes it seems to appear that if we were LPR's that she would get here soooner? Am I reading that right?

The only place that being an LPR gets your adult child here faster is the Philippines so many people petition from there it is a different game. A sibling there take about twice what other places take.

This will not be over quickly. You will not enjoy this.

Look at the most recent Visa Bulletin. It's not faster for an LPR to petition an unmarried child over 21 versus a USC petitioner.
