Hi I want to know if on the forms for AOS I'm (female USC) suppose to use my maiden name or the last name acquired through marriage?

Also does anyone know where can I get an example or how to do the cover letter for the AOS package?

Lastly is it necessary to fill out the Advance Parole form? He doesn't plan on traveling should he still fill it out? If yes what date range should he use?

I believe if you wanted to change your maiden name to your husband's surname you should put it on the form I-485. Marriage certificate is a proof that you legally can change your last name.

I, myself, did not file I-131 because I don't have any plan leaving the country any time soon. Regarding of cover page, here one example that might be helpful.

*Form I-864 with supporting documents: a copy of 2013 federal tax return and W-2.

*Form I-765 with supporting documents: 2 passport-sized photographs, a photocopy of Indonesian passport biographical page, a photocopy of Indonesian passport K-1 page, and a copy of I-94 arrival/departure record.

Copies of documents are exact photocopies of unaltered documents and I understand I may be required to submit original documents to an immigrant or consular officer at a later date.

You WILL want to put everything in the married name. As far as the 131, it's free so you migth as well file for it. You never know if you don't have an interview and get a "wavier for interview notice" and it takes up to 9-16 months to get your green card.

If you changed your name when you married, then yes, use the name you are currently and legally going by now.

Yes, he should fill out the I-131 too. Sometimes emergencies happen and there have been too many posts from those that had wished they had filed for the AP when they sent off their AOS paperwork. You do not have to use it, but it is good to have in case you need to. The green card approval can take 4-10+ months.

No cost to file the form with a pending I-485, same as the I-765 for the EAD, and the I-131 is pretty short and easy form to fill out. Most of it is skipped for those applying for AP. As for the date and length of travel, leave those blank and when you print out the form, hand-write Unknown for those. No explanation/reason needed for why you want or need the AP.

I did everything with my maiden name I didn't want to risk anything being messed up for my husband. It's just a name :)

As for AP, you should definitely apply for it. It's included in the price of the application and you never know what could happen during this process. God forbid something happen to a family member he wouldn't be able to go back to DR without it. We filed in January and we've got an interview waiver saying it could be up to 6 months more before he gets his 2 year card so by then it will be almost a whole year. I can't go a year without vacation!

10/8/14: Called USCIS and was allowed to file a Service Request since we're outside of normal processing times for our local office. Should have a response in 15-30 days.

10/29/14: Received letter (dated 10/27/14, exactly 1 day before the 6 month mark) stating that our case would be transferred to the Houston field office for processing.

11/28/14: Received letter (dated 11/20/14) stating that our case had been received at the Sacremento office and would be processed there and if we don't hear from them in 60 days to contact NVC.

12/9/14: Card is in production

12/16/14: 2 year card in hand!

i would recommend filing the i-131 if there is any risk at all of him travelling during the AOS process. i didn't apply for AP when i first put together my AOS packet (because i was lazylazy) and ended up missing out on a work trip that came up at the last minute because there was just not enough time even when my company tried to expedite.

generally i-131's take 3 months for approval. you need at least 2 weeks from when you file the i-131 to get the AP, 1 week for USCIS to give you the receipt notice of the completed i-131, and another week for all the mail transit (for your i-131 to get to USCIS, and for the AP to get from USCIS to you assuming USCIS approves immediately if your lawyer is good).

i also recommend using your name post-marriage, especially if you've changed your name on your other identification docs (e.g. drivers license, SS card etc).
