I-130 Nebraska status...

On May 12, 2014 they recieved my I-130 petition for my spouse. I have recieved the 797C hard copy and it's been over a month already without any update on the case. Some people already had their case approved less than a month. Am I missing something? I called them and they said it'll take up to 5 months for a decision. Isn't there are some paper work at the Nebraska USCIS for me to fill out? Can someone help?

May 7, 2014 - I-130 sent to Chicago, IL Lockbox

May 12, 2014 - Case recieved at Chicago, IL.

May 13, 2014 - Case accepted. Received LIN#. Case forwarded to USCIS, Nebraska. i-797 hard copy received shortly after.

Suggest you read the guides available on VJ closely - absent responding to an RFE (if you receive one) there is nothing to do but wait for USCIS to finish their work. You can check case status online with USCIS - in the event you have not received your NOA2 after about 5 months you can call to check status. If that becomes necessary check the guides here for how to effectively obtain information when calling (it isn't as simple as asking the person who initially takes the call). While you are waiting you can plot out all of the information you'll need for the next stage - police checks can take time in Vietnam so planning in advance is helpful.

You will not receive any paper work from USCIS unless they want something from you (in which case they will send you an rfe stating you need to send them something) or an NOA2 (which is your approval notice). Until then, start gathering your paperwork for the NVC stage such as your AOS (i-864) and domicile documents if the US citizen is living abroad.

04-29-2014: NOA1 re-routed to CSC

05-14-2014: RFE

05-30 2014: RFE response sent

05-30-2014: RFE RESPONSE RECEIVED

06-04-2014: NOA2 I-130 Approved!

06-13-2014: Arrived at NVC

06-30-2014: Case # and IIN assigned

07-18-2014: D-261 sub mitted

07-18-2014: AOS fee invoiced

07-19-2014: AOS fee paid

07-25-2014: AOS package sent
