I'm not sure what I do. I'll file my 2006 taxes even though I have no income to declare. Should I phone them and tell them that I am moving to the US, or include a letter explaining and send it with my taxes? Is there a form I have to fill out?

I've always used an Accountant in the past, they figured out all my deductions, but I won't need any of that this year.

Any advice is welcome!

This is such a great question. I was just trying to fill out the NR-73 Determination of Residency Status (leaving Canada) and feeling a bit overwhelmed by teh whole thing. I just left Canada in December and still have bank acounts and driver's licence, but of course eventually that will change. My head is spinning right now. Some of these questions are just crazy! Ah, the paper trail never ends...

September 13/06- 3 Emails stating we got NOA2, APPROVED!!! Dated September 8,2006.

December 6,2006-Interview in Vancouver APPROVED!

Arrived in US- December 14, 2006

January 3,2007- Applied for SSN got within 7 days in the mail.

February 17,2007- MARRIED!

March 2, 2007-Started AOS paperwork

March 12,2007- Filed AOS, EAD, AP Docs.

March 22, 2007-NOA1 for AOS,EAD, AP

March 23, 2007-Receive "Biometrics Appointment"Letter

April 4, 2007- Biometrics Appointment...done..

April 19,2007-Notice in Mail saying transfered to CSC..not sure what is up with that...

May 21, 2007- Touched and email saying case pending at CSC.

May 23,2007-AOS Touched!

May 25, 2007-AOS Touched-Again

May 29, 2007-Email AP APPROVED.

May 29, 2007-EAD touched

May 30,2007-AP and EAD Touched

May 31, 2007-Email stating I-485 Card Production Ordered!!! WOOHOO!

June 1,2007-Email EAD Approved

June 2, 2007- AP Received.

June 4, 2007 -Welcome New Permanent Resident letter received.

June 7, 2007-EAD Card Received..no GC yet..

June 9, 2007-GREEN CARD IN HAND!

If you notify Canada Revenue Agency of your new address they will send you the tax forms that you will need to do your 2006 income taxes. You use the same form as normal but there is a question in the beginning that asks if you left Canada and on what date. You would fill that out. There is also an excellent little reference book you can download from the CRA site entitled "Income Tax and Emigrants" - this is for people who leave Canada during the year. It isn't that difficult to do your exit taxes - a lot easier than doing the US taxes! Basically you pay tax for the part of the year in which you were in Canada and earned income. You are also entitled to the deductions for the same part of the year. If your sole source of income for the year was Canadian based even after you moved to the US you are eligible to claim the full year's deduction but you need to include a letter with your taxes requesting that allowance.

If you are physically resident in Canada right now as your timeline indicates, 2006 is not the last year you will file taxes in Canada. You will file 2007 taxes next year, as you resided in Canada for a portion of 2007.

When you file your first set of taxes after leaving Canada permanently, you will fill in the box on page 1 of your tax forms with the date you ceased to reside in Canada.

You don't need to let them know you're moving other than that, unless you want them to mail your tax forms for 2007 to your US address. I forgot to do that, so used the forms on the website.

I believe the NR-73 is an optional form. Most people don't fill it out (me included). I think the member here named Cassie has some experience with it, as she was asked by Rev Canada to do so.

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

We can e-file? I thought I'd read somewhere a while back that we have to snail mail our stuff in if we're not living in Canada... could be mistaken though! E-filing would be much easier.

I departed Canada in 2005. SO when I filled out tax forms for 2005 I used a software program to dothe taxes, BUT mailed them in. As well onthe very first page of the tax forms it asks what dat you baecame OR CEASED to be a Cdn resident, I put inthe date I crossed the border to the USA. I never filled out the NR 73 form. I belive for soem unknown reason I checked the GST rebate box ?? And I received a letter back stating I was no longer a Cdn resident, thus not an option for me, plus I made too much $$. As well one can go onto the Canadian Governtment web page and once you sign up for it (think you need last yrs tax info) you can change your address. Its not official or anything, but if they need to get in contact with you, they can find you. Just my 2 cents

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

If you are receiving any type of government benefit - ie. GST, Child Tax Benefit, stuff like that - you do need to notify CRA that you are moving, even if the money goes direct deposit. You will not be eligible for any cheques issued after you leave the country and will have to repay them.

The NR-73 is not a requirement, it's you just getting their opinion about your residency status in advance... All that is required is filing a leaving Canada return. You do this by submitting the same T-1 for the province that you lived in when you left and placing the date you left Canada in the box on the first page... If you have no income in 2006, that's all you pretty much all you have to do...

However, if you get EI during 2006 in the US, you can get a refund of a portion of the Non-resident taxes that you paid. You file a Section 217 Return... if you do this, you treat the income earned by the EI the same as if you earned it in Canada in terms of your personal worldwide income (income earned in the US + your EI income. If the amount of taxes that would be charged is less than the 25% non-resident tax that they withheld, then you get the difference back. If your only personal income for 2006 was the EI, the refund could be significant. My wife got a $2,500 refund back last year by filing a Section 217 return...

If you lived part of the year in Canada and part of the year in the US, you can file a partial Section 217 return...

You cannot efile a Leaving Canada return. It must be mailed to the International Tax Services Office in Ottawa...

Yeppers filled out Section 217 and got a nice return!! Ty canada, lol At first I doubted the amount I was to get back could be correct. So I called up revenue canada,talked to a very nice guy, and he said, yeppers, all sounds correct, and if not, they would readjust it. Sure enough the $$ arrived as planned last yr.
