help! marriage, NOT staying!?

My fiancé lives and works in japan. we visit each other frequently. We want to get married here in Utah where I live, next time he comes to visit, because I will have family and friends here that would not be able to attend otherwise. He will then go back to japan. I will move there next year . I have asked around, and I am not really getting a straight answer. I need help. Do we need to apply for the fiances visa, where he is not planning on staying, or living here in America?? Or can we legally get married while he is here as a visitor? I cant stress enough, he is NOT staying in America. He will only be here for a week, then he will go back to japan to his job, and his home. can someone PLEASE help me??

Well...since he plans to live in Japan and not immigrate to the US...as others have said...no need to apply for a visa. That being the case, I'm assuming that you will be immigrating to Japan to join your husband? In that case, you'll want to investigate what is involved with that.

No problem at all from a visa/ immigration point of view, as everyone has said.

Make sure you check local laws, some have rules as to how long you need to be in the country before you can marry etc.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Congrats to you!!!! As everyone has said above all he needs is a tourist visa which from Japan as part of VWP means only ESTA. He should however be prepared to show truth of intention to return to JAPAN and be truthful about his intent when he presents to CBP. As always answer questions from CBP honestly but don't volunteer information that is not asked from. He should be fine.
