Hello!

I am seeking advise on the subject of permanment resident petitioning her children to come to the USA. My friend is current Filipino Women that I meet a year ago in PA. She is still married but estrange from her husband due to his legal issues. She moved to TX to be near some friends and find work. She currently has 4 older children between 23-18 that are not married. She would like to bring her children her to the USA. During her marriage she petition once back in 2009 to bring them here but she said the petition is expired and income was a factor at the time. Well she wants to start the process up again. She has her 10 year GC and is with 2 years credit towards her US citizenship.

My questions to anybody is what is the best solution for her to bring her children her. She would like to start petitioning her children her without her husband and is working on earning more income to help her petition while a still GC. Which is better start now or just wait 4-5 years and get her US citizenship? I think should start now as a GC holder and try to bring 1 or 2 children her and work on the other 2 or is it better to wait until US citizenship. Is there a benefit just to wait for citizenship despite her children will be older?

Start the petition now, she can upgrade once she gets citizenship IF it is faster (currently it would actually be slower by about 6 months for a Philippino). Make sure none of the kids get married, it would cancel the petition.

It currently takes 11 years for unmarried adult kids of greencard holders to get their visa

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Does the lenght of time make a difference if she waits until she get US citizenship, (LPR=11 years) vs. US citizenship (<11 years, maybe 5 years)? Are the petition cost still the same no matter if she is LPR or USC? Thanks for any information.

Cost is the same.

No reason to wait to file.
