Ok... it's about time to start preparing income taxes, and I'm confused.

I normally file the 1040EZ as a single every year, but now I'm married

and my husband is overseas (he won't be supporting me financially until

he gets here in March or April). Do I file single or joint return?

Some of the lines I'm not sure if I should use the single or married options.

You are married so single is not an option anymore.

You have three choices:

Married Filing Separate

Married Filing Joint (only if you opt for the special provision which requires you to treat your non resident alien spouses worldwide income as US based income)

Head of Household (only if you have another qualifying person ie.. child or other household member you support)

File married, you get more deduction on your taxes! Married filing seperate actually penalizes you. As long as you have his & your SS#, you are better off filing married.

A non resident alien spouse who has never been to the US would not have a SSN. You would need to get an ITIN for him.

I was looking at W-7 form. What Should I send them along with w-7? Its says attach w-7 with your tax return then What should i put it in tax return. Please help if anyone gone through this process.

IRS is useless, realtime experience required in filing and getting ITN# for my wife to file it jointly this year.

You need to send in the W-7 with your tax return. There is a specific address you need to send your income tax return if you include the W-7 form - application for ITIN.

We included notarized copy of passport of my wife's passport on the application. She got it notarized at the US consulate for $30. It was worth it.

The instructions are pretty clear about the additional documentation that is required to be submitted along with the W-7 when you attach it to your return (original valid passport or notarized or certified copy of a valid passport). If you do not want to attach the passport there is a list of about 15 other items that may be used (you need to select two off the list and at least one must have a photograph and one must demonstrate your foreign status).

If you do not want to attach the original documentation to the return in hopes that they will indeed return it, check with your local Taxpayer Assistance Office (TAC) of the IRS as some will process the W-7 independently.

Thanks very much fwaguy... I'm in the same situation and I just got my W2 from my employer yesterday. I knew I needed to use a W7 form to get her an ITIN number and needed to send it to a special address. However, I didn't realize I needed a copy of her passport. My wife is in the process of updating her passport to her married name. Once she's got it she's going to get a notarized copy and send it to me. Thanks again! :)
