I sent in the packet for my wife(I-485 and I-130) packet in April. Just this past Monday we had her biometrics appt.

Then this morning we got a letter saying that our check for $1490 bounced! The letter says that the money is due by next week. It seems as though I gave access to my bank account to a relative(a student) for expenses and I gave them access to the account I had started specifically for this. Now the money is gone, my relative could not possibly pay it back and I will not have $1490 plus the $30 dollar late check fee for another month.

I called the number on the letter and they told me that the application would be rejected next week and I would still have to pay the $1520 PLUS another $1490 when I have to resubmit it again. This sounds ridiculous but the women on the phone was sure of it.

I then called the 800 number she gave me to check on the status of the application and they told me they did not know what would happen(i.e. rejected, not rejected, everything mailed back and have to do biometrics and everything all over again etc).

Does anyone have any experience with this? What actually will happen as a result of this bounced check? Will we need to pay twice as the first customer service representative said and do the biometrics all over again?

This almost happened to me. I wrote the checks but didn't have enough in my account because a check took an extra day to clear (UGH!). I emailed my lawyer and a bunch of people who could help. Here is what they all told me:

What will probably happen is that they will try one more time to make the withdrawal, and if it doesn't go through, they will mail the whole application back to you and you'll have to refile when you have the money. That's all.

I ended up having the funds the next time they tried so it didn't happen to me, but my lawyer said sometimes they only tried once so we were ready to refile if/when they sent it back.

Don't stress, you'll be fine :)

You might want to do a cashier's check next time though. Just to be sure!

I cannot tell you what USCIS will do but in regards to your bank, because the check is already NSF (bounced) it will be returned to your financial institution and you'll have a returned check fee (usually $30). Plus whatever fee USCIS will charge you for returning that check.

You will not have to pay that $1490 twice. When the check tried to clear your account, it would have put your account into a negative balance. Then your bank would have notified USCIS that there were not sufficient funds and the check is returned. Once it is returned, those funds go back into your account and your account will be at the same level it was at before the check cleared.
