Need Help! My wife is a US citizen now. My mother in law has her green card. We need to bring my wifes brother, wife and son to USA *as soon as possible*. Donetsk & Lugansk fighters are rounding up all men to fight an offensive against western Ukraine. We are trying to get my brother in law and his family out of the country ASAP on an asylum visa. All three of them do not have international passports, just internal ones. Does anyone here have any expertise in asylum visas or can direct me to someone who has knowledge of this? I filed the K1 visa for my wife 10 years ago on my own and it seemed very straight forward but I cant find any good info on the asylum visa. Or can anyone please recommend any good attorneys that specialize in asylum visas? Thanks so much! Time is of the essence!

There isn't one. You can apply for asylum once you're in the country, but can't get visa because you want. There will few billion people applying for it otherwise...

Thanks. Doing some research I need to bring them here on tourist visas or at least file I-130 Petition for Alien Relative for the brother.

Visa for brother is going to take ~13 years. Tourist visas are probably unrealistic and "bringing them" using those is a fraud anyway.

It doesnt take 13 years. Ive brought other relatives on tourist visa (from Poland and from Ukraine) and its a matter of months.

You're up for quite a surprise then... Sibing petition priority dates are currently 22DEC2001. Permanent resident (his mother) can only bring umarried children. Once she becomes a citizen, waiting time is 11 years. Keep reading cause you have something very wrong.

I am speaking with an immigration attorney right now. There is no fraud involved. They are arriving on a tourist visa and if they so choose they can file for asylum. I also own a business and can bring them here on a worker visa, although its much more difficult from what Im told.

I'll stick with advice from an attorney over replies here, thanks. I did all of the K1 visa myself, which was not difficult at all and I recall all sorts of ridiculous time frames from 2-15 years, all of which were not true.

Ok. Seems like you got it all figured out. Easy to get tourist visas with the intent to immigrate. Easy to get work visas for relatives.

Why bother coming here to ask for advice that you are going to ignore?

For asian countries yes, 13 years is probably normal. I have a relative who has waited years for her relatives in asia.

There are ways and that is why I asked for tips. I-129 is 1-2 months. If there is a will, there is a way.

Not just Asian countries. It's every country except mainland China, Mexico, India, and the Philippines.

You may want to research F4 petitions and the Visa Bulletin.

You are working under a lot of misconceptions. Just want to point you in the right direction.

Will alone does not create an appropriate visa category. Laws create visa categories.

If will was all that was necessary, there would be no reason for the rest of us to wait years to bring our families to the US. Would be kinda stupid of us not to pursue quicker routes.

To get tourist visas, your family will need to show strong ties to the Ukraine to overcome the presumption of illegal immigration.

How are you going to address that?

You also stated that you can bring them on work visas with a little difficulty.

Have you ever brought a foreign worker over before?

What would you hire them to do?

If there was a fast way to bring family members to the US, we all would be using those routes.

We would share the information with each other.

If there were faster routes, why would us dummies wait in lines for over a decade to bring our siblings to the US?

Why would we not choose faster routes?

The answer is that there are no faster routes.

It's not easy getting a tourist visa or a work visa.
