With regard to the 90 day notice thing - I've never understood anyone's need to adhere to that. You're emigrating to America - so what if your boss says you have to give 90 days notice?? You can just finish on Friday and say "bye" giving no notice at all if you felt like it surely? What are they going to do? Ask the U.S. government to extradite you for failing to give the required notice at work??? Or am I missing something??

They may want to use them as a reference when applying for jobs and leaving without giving notice might be problematic if that is the case.

Just playing devil's advocate here, but another option might be to hand in her notice when she's getting close to the end of the process, ie after the NOA2. A bit safer than guesstimating when your visa will be in-hand before the NOA2. She probably wouldn't be ready to go as soon as the visa is in her hands but she'd keep her bosses happy and be able to put away a bit of extra cash from the extra few weeks of work she'd be doing.

She should accept the promotion and look after number "one" - that would be herself. The visa process is on average a year start to finish. Even if she has to give notice, she will likely be able to negotiate on a good faith basis until she immigrates to the US. Most bosses do not want he employee at the job to work the full notice, unless they will be really struggling for a replacement in the interim.

In a nutshell until she has that piece of paper in her hand, she should not do anything irrational.
