Gentlemen,

My wife is finally scheduled (hooray!) for her AOS interview from a K1 visa. We received an I-797C with a long list of documents to bring. Among them is listed her (Applicant's) birth certificate. We submitted an original (not copy) of her birth certificate when we filed the I-485 back in January, along with an English language translation. We submitted another original and translation when they asked for her birth certificate AGAIN in an RFE.

My question is, do we really need to bring yet another birth certificate for her to the interview? It's extremely inconvenient and expensive to keep having these mailed from Japan.

By the way for any future interactions with USCIS, you should NEVER send in an original of anything unless specified by USCIS. On the RFE it would be in capital letters to send in the original. I am guessing they are having issues with your translation document. Good luck.

Let me ask the question a different way. When we get to the interview, will the interviewer have all the materials I submitted in my application, in the room? If so, they will already have two original birth certificates, with translation, in the room and I don't need to bring a third one..

I understand what you are saying, but honestly you will have to wait until someone else chimes in because most people don't send in originals. But if you look on your interview notice is specifically states you must bring originals and copies of the following documents.

To be safe, if I were in your shoes I would bring originals. You never know if documents get misplaced at USCIS.

Your call.

I just want to update this post with my experience at the interview today. The interview was painless and the IO did indeed have our entire file with all my documents contained in it. He remarked without prompting that he "couldn't understand why they kept asking us for the birth certificate since it's right here in your filing". He didn't ask to see any of these documents that were already part of the record. Your mileage may vary, but this was my experience today. Thanks VJ.
