Hey all,

Do we have to wait for the actual Marriage Cert or can we use the temporary for the AOS paperwork? How about SSN # ?

thanks

Yes, you need to send a certified copy of the marriage certificate (not the marriage license) for the AOS. A certified copy is highly recommended (over a regular photocopy) to avoid RFE. You can get an extra certified copy for a very small fee (For ours, it's only 10$ each). See the guides (link below) for more info.

You don't need SSN prior to filing AOS. But I would recommend that you apply for this soon-ish as it proves to be troublesome for most who applied only after they received their EAD/AP card. Make sure you have atleast 15 days left on the I-94.

Btw, When you have a chance, :time: , it helps everyone here who use the forum.

I sent in the copy they gave me at the courthouse and never got an RFE. I believe it'####### and miss. If you get tagged as the hit, it will delay your case for up to 2 months. Your choice to wait 2-3 weeks or have the chance of waiting up to 2 months for them to review the RFE.

We got married in Los Angeles, CA and were advised of the 8 week wait for the certificate. We decided to send in our AOS with customer copy a month after getting married. We made that decision based on the 90 day validity of the K1 visa. I did not want my wife to become out of status at any point because of having to wait for our marriage certificate. We did get RFE for the marriage certificate and 2013 taxes. Sent back RFE 2 days after receiving it. We're 30 days into the 60 day waiting period to receive a decision after sending back RFE. We have not seen any significant delays because of RFE. I do not regret the decision we made.

I made a color copy of the certified copy of the certficicate and sent that. No RFE. From what I've read on here sending a certified copy isn't needed and just a really good clear copy is sufficent.
