I am really still surprised about this Vawa thing works:

- I got an infoPass and handed USICS my withdrawl of the affiditiv of support mentioning in it that she married me to get a green card. The affidativ was withdrawn.

- She got a letter from USCIS saying that I revoked my affidativ of support and she is inadmissible.

- She left the country for 4 months.

- Came back.

- If/when she files for VAWA (with no proof of abuse, nothing) and she will be able to get a green card!!!

I don't care if she will get a Green card or not. I am just surprised that this Vawa officer will believe this story and approve the vawa.

The official doctrine is that they need to err on the side of caution.

If something happens to the victim after declining any kind of petition under VAWA, it also impacts career or reputation of the reviewing officer (of the court, police, or any other reviewing agent) as having failed to protect the victim.

You stand far, far more to lose than just the attempt to block her acquisition of a green card if she decides to envoke the local courts to create the paper trail.

But from some have suggested here, VAWA claims may be an indepedent matter with the USCIS/VSC. But if they want to see evidence of local petitions to establish genuine concern, then, , hide, run. Absolutely no contact with this person whatsoever, as many have also mentioned.

This is very interesting. All I know at this time is to stay away from her.

1-Is there anything on my part to do after I widhtdew the affidativ of support, filed for divorce and filed a copy of of it with USCIS?

2- Do I need to make an Infopass and tell them I am worried about VAWA? not to affect my future petiion for someone else?

Thank you all for all the help so far.

You've done all you can at this point. Unless you have solid proof of her intentions to commit fraud, telling them your fears will do nothing. Anything you say that is just your opinion, or something you overheard will mean nothing in any attempt she makes for VAWA. You'll be viewed as a disgruntled ex.

I also wouldn't worry about a VAWA attempt affecting any future attempt to petition someone. As a K-1 petitioner, you've burned through your one opportunity in two years to petition a K-1, and one of the two lifetime attempts you have. Anything over that requires a waiver, which supposedly is not hard to get. Allegations in VAWA cannot affect you, without a proven case in court, which VAWA is not.

Agreed, it's a waste of time bothering with USCIS beyond what you've already done. Not only will you be viewed as a disgruntled spouse, but you may also bolster her claims of being a controlling and abusive spouse.

Just leave it alone and continue to be vigilant on the legal side of things.

Good Luck.

Capri 12 pm Today:

As for the OP the rest of the advice above is pretty much all that needs to be said. Since you listed CA as your state it may not be too far fetched to assume we are talking about Mexico as the land border crossing here? Border patrol- in certain areas isnt as great as it should be. Its not crazy for someone to use an EAD combo card like she would have and a US drivers license and drive on through depending on the time of day/agents on duty etc. The only odd thing is how do you know shes talking to a lawyer? You shouldnt know. Stay away from her and those that know her. It will only make trouble. The more presence you have in her life or you keep yourself intertwined with her the more likely it is some kind of incident will occur between you two and you will end up in hot water.

Please confine your discussion to the OP's actual circumstances and do not introduce extraneous nor unrelated situations that mislead and misdirect the conversation from the actual facts involved. Any further posts that derail this thread from the OPs situation will not be moved but will just be removed.
