NEW affidavit of Support for AOS

Hello everyone,

My wife has now made it to the US and we have officially married.

Now that we are going to apply for AOS is it necessary to fill out another I-894 Affidavit of Support? Or can we use the same ones we used for the I-129f?

Also is a certified marriage certificate copy necessary?

The answers are yes you need to file a new affidavit of support form. Be sure to use the form they ask for with the I-485.

No you cannot use the I-129F form. Although in my case, our interviewer had all the information from both cases in our file, they REQUIRE a new form to be filled out as per the instructions in the Adjustment of Status.

Yes, you need a copy of your marriage certificate. I sent an original certified copy, but that was because I knew I'd be going through this stage and just ordered extras. If you only have one, you can probably be alright by sending the copy. If they need the original, they may ask to see it at the interview or have you send it in via RFE if you don't have an interview. If you are still waiting for the certificate, go ahead and order an extra to be safe.

Yes. An Affidavit of Support, I-864, with its supporting documents, is one of the requirements of I-485. This is different from the I-134 submitted during the embassy interview of your then fiancee (now wife).

Not necessarily, but a certified copy of the marriage certificate is highly recommended (over a regular photocopy) to avoid RFE. You can get an extra certified copy for a very small fee (For ours, it's only 10$ each). See the guides (link below) for more info.

ya - it's required - the I-864 -

luckily - if you kept a copy of the I-134 - you can copy over data from that into the I-864.

Just one more question. I had to have my mon be a co-sponsor for the previous affidavit of support. If I do not reach the guidelines will I need her to be a co-sponsor again?

Your gross income has to meet 125% for your household size. Otherwise, you will need a co-sponsor.
