I am about to have my AOS interview. I am currently a Civilian Contractor working in Afghanistan, and due to being seperated ever since she landed in the states do you believe it would be a good idea to have an Aunt write a sworn statement about our "true marriage". Or do you think that will throw a red flag with the IO at the interview?

Any advice would be great.

Mike

That's would be good idea but not extremely necessary, it's simply a plus to support your true relationship.

As long as you and your wife have same address in the US even you're working as contractor in Afghanistan separated from her and also having proofs like wedding pictures, shared bank accounts statements or properties in name of you both being separated won't be red flag because you're being contractor in other country and that's your job.

If your wife and you lived in different states with different addresses by no reason then that would be a red flag.

Hope it helps. Regards.

Yes. It defintely helps.

We have everything together:

Joint Checking Accounts

Joint Car Insurance

Joint Helath Insurance

Joint Personal Loans

Joint Car Registration

So I believe we shouldn't have any issue at all. Just don't want to chance anything with this lovely government of ours.

Let me know how that goes for you because I am kinda in the same situation. I have to work in France for every Summer and my wife is currently living in other state with my real aunt. My wife just came to US about 3 months ago and have no driver license until now. It is hard to live by herself in new country without me for the first couple months. Therefore, I decided to let her staying at my aunt house in other state until I am coming back. We do have bank joint account, health insurance, credit cards, car title, lease ( even though we still pay without living this summer), electric bill, cellphone bill, regular photo not wedding pictures, airline tickets for the trip to my aunt's state, her ID is still having the same address with me. I dont want to change her ID address to my aunt's address because she just lives there temporary. I worry about the red flag but I have no other choices.

We did submit AR-11 to USCIS and she got her EAD/AP at the new address. I-485 is still Initial Review. I am also thinking to ask my aunt to write a letter to state that my wife lives at her place while I am working in France.

Any advice would be appreciated.

In your situation, I would have your Aunt write that letter and explain how she is helping you out while you are in France and how you two are always on skype together and messaging back and forth (have her notarize it and do it as close to your interview date as possible) and that should be good enough. At least I can only hope.

We usually communicate through Facetime which is hard to prove because Facetime does not record in the phone bill. We did send snail mail letter but it is just 1 letter/ month. It has been 2 months after biometric and her I-485 still does not change.

Thanks for advice.

If I'm not mistaken, you can do print screen's off your electronic device that shows each time you called her. As far as the 2 months, there is no set time for getting an interview. Has she received her EAD card?

Yeah, I can screen print and that is all I can do. She recieved EAD/AP 10 days ago.

If you can screen print, you should be good to go. I did the same for her K1 visa interview and wrote a statement about our situation and was approved in less than 5 minutes.
