Hi all,

My husband and I are filling for the AoS and my main concern is that we both graduated from college Dec 2013 and will start working July 2014. We plan to file around October 2014, the latest. I'm adjusting from F-1 student visa.

So basically, on our past tax returns, we will have virtually no income (and I think he filed as a dependent with his parents for the past years). We did do some part time work while waiting for our jobs to start, but it was just supplementary income (like $1000/person per month).

Will just his pay stubs from July-Oct along with the employment letter be enough proof? Should I include mine as well? What else should we include/should we have a letter explaining the situation?

His parents barely make enough to support themselves, so we are trying to avoid going the joint sponsorship route unless we have to.

Hey lil2be,

His income is enough to support the both of us above the poverty line requirements. My main concern is
a) If his job only starts in July, will 3 months of pay stubs be enough proof?

b) Is it necessary/helpful at all to include my income in the AoS packet?

A) as long as your husband filed tax return forms last 3 years. I think it should be fine. Because you guys will need that 3 years to show them. Then your current situation where he just got a job. He will need to show an employment letter, pay stubs and possibly your own word explanation letter. I don't think it would hurt. I am just not sure as I have never read throughly about income above poverty guide line which should be certain of months or years.

B) as I said your income is not needed. You are not a US citizen. You can't sponsor yourself. And there is no where in the form to put your incomes. They just want to know the sponsor's income.

Intending immigrants who are spouses of the principal sponsor can have their income added if they live in the same residence and can prove that their income will continue after obtaining residency (See the I-864A instructions). So you may be able to pool your income, but as a student worker, the government may not consider your job to meet the requirements for sponsorship.

1/24/2013: Biometrics again...
4/1/2013: First Green Card from November finally arrived...

4/22/2013: Replacement Green Card arrived.

8/9/2014: Filed I-751

8/14/2014: Received NOA for I-751

3/12/2015: ROC Approved!

7/18/2016: Sent in N-400 to Texas lockbox

7/21/2016: N-400 delivered
