It's definitely possible, ET. I've been told that at my company, when RIFs have happened in the past, more senior employees have a much better chance at keeping their jobs despite productivity (or not). And I'm in a non-union, professional environment, so...

When I was laid off in '04, I know productivity was not the reason; the company was in trouble and I was the low gal on the totem pole. My boss (who was laid off himself a few months later) fought to keep me. I know for a fact that my position was eliminated and has not been restored, more than a year and a half later.

My position was eliminated due to financial constraints. That seems not to have any negative connotations and did not affect my status when I interviewed at other places.

It does suck though! :( I've been fortunate that every cloud has brought a silver lining!!!

Not saying that it can't happen that way. It just hasn't been my experience when we got together to decide who gets to go. It sure wasn't the most junior staff... :no:

I don't really have much as advice since the only time I was laid off was when the whole company closed. We were given a few months notice. It actually worked out to my benefit because I stayed with the company to the very last day and the company that hired me afterwards selected me because I had stayed with my previous employer to the very end.

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

If your position was eliminated, then that would probably be my line of attack - "My position within the corporation was eliminated due to downsizing, along with various others including administrative staff, front office employees... etc. etc."

If they have let you go using a reduncancy as the reason and then hire someone else for your job, I would think you have some claim for wrongful dismissal - even in an "at will" state. I asked my hubby about that (we're an "at will" state too) and he wasn't sure, but I know you can in the UK.

Good luck on finding something new (and temping isn't so bad once you get used to it!).

Hey everyone! Thanks so much for the suggestions. I have already lined up a temporary thing (where my mom used to work-they wanted my mom to do some extra work and they got me!!) for next week and I'm confident I'll find something very soon. Thing is, it was my own stupidity that got me laid off. For heaven's sake, I'm an Accountant-I knew the company was in financial trouble and I chose to ignore it. I thought we'd be ok. In this case, several positions have been eliminated in all the departments. I'm the second to go in the finance department. It was between me and the other Staff Accountant, and he has more seniority than me. We do two completely different jobs so it wasn't performance-based (like he was better than me). Would have been like comparing apples to oranges. I even talked to him yesterday and he told me that's what my boss told him. So I felt a little bit better at least that I'm not a total loser! Haha... Well off to the web sites for some fun searching.

Don't let the sunshine spoil your rain...just stand up and COMPLAIN!
