We were married under a K1 visa, applied for Ajustment of status, advance parole, and Employment Athorization all together back in November of '06. We just received the Conditional Residency Card that we will have to remove the conditional status in 2 years. The question is can my wife use just the Residency card to travel outside of the US or does she need to wait for the Advance parole card to get approved and come in the mail? The reason we ask is that on the paperwork that came with the card said that if she was planning to be out of the states for more than a year she would have to apply for special permission... which leads us to believe that she could use just this card to re-enter the US if she were to leave to country to visit family. Thanks for any help in advance.

Yep, you're right, with the green card she's free to travel and work.

Feb 2005 - both return to Germany

09/01/2006 - filed the petition in Frankfurt

09/06/2006 - medical in Frankfurt

For short visit, you will not need Advance Parole anymore. The Green card will suffice. I used Green card for short visit & was admitted back.

Feb 21, 2005 : IV fee generated

Feb 25, 2005 : Sent I-864 fee bill

Feb 28, 2005 : I-864 fee bill delivered to St Louis

Mar 3, 2005 : IV fee bill received

Mar 7, 2005 : Sent IV fee bill

Mar 9, 2005 : IV fee bill delivered to St Louis

Mar 28, 2005 : I-864 fee credited against case.

April 6, 2005 : Received I-864 package

April 7, 2005 : Immigrant Visa fee credited against case.

April 11, 2005 : DS 230 is generated

Aug 12, 2005 : I-864 & DS 230 received by NVC

Sep 14, 2005 : RFE on I-864

Dec 9, 2005 : Police Cert requested from the Netherlands

Yes, she can travel with her Green Card. That is her official proof that she is allowed to live in the US. The Advance Parole is used before she gets her green card but after she has applied for it. Since her green card was processed faster than the AP she no longer needs the AP. If she were planning on being outside of the country for longer than 6 months to a year then she would need to obtain a re-entry permit before she left the country. There is no extra form required for travel less than 6 months. She just enters the immigration line for citizens and residents on her way back, shows her green card and passport to the border officers, and re-enters the country. Have fun!

Just to clarify, the Conditional Residency Card she received is AKA Green Card ?

An LPR does not need advance parole to re-enter the USA, they just need their I-551 card (Green Card).

There is no "Advance parole card". The advance parole documentation is a piece of paper, in duplicate.
