Hi everybody and i will appreciate every advice you guys will offer me...i benn married to us citizen for like 5 years and 5 months...we did fall in love but a lot of things started to occur in our relationship..my wife really abusive verbaly and physically she loves to be in control for everything...verryy jealous and insecure that i cant even work with females at work..i found my self asking my supervisors to out me in different schedules and hopefully i will get to work with a guy or ny wife goes insane...i mean things got wayy to worse than i thought....one time cop got involved and i end up droping charges cuz shes my wife and i cant see her in jail.....i mean just the whole relationship got to the point theres no return..she got some medical problems so i told her you can stay home and relax and i will take care of the bills so im working monday throug sunday so we can afford the living....so now shes threatning me if we divorce she will call immigration office and tell them that i led her throug this whole marriage,i mean ive enough evudence to prove that our marriage was valid and build on love...but i just dnt want this to get in my way if i wana apply to citizenship...like i said i been in usa for over 5 years...if i wana apply for citizenship can i apply for it without throug marriage even if we r still married????

If you have been an LPR for 5 years or more you can apply based on the 5-year rule. You don't need her. Look on your greencard and if it says residence since 06/15/2009 or earlier you can apply. Even if you apply based on the 3-year marriage basis, you don't need her approval. But you'd need proof of marriage (like a marriage certificate, and joint tax returns) and proof that she is a US Citizen (birth certificate or passport, for example). Go to the USCIS website and you can figure out the guidelines.

Good luck!

Even if she goes to USCIS and tell them that they are not going to listen to her. I hope you have your evidence for the abuse, or like a copy of arrest or something. That can show them where the problem is coming from. I hate when people think that every immigrant is married just for a green card. Don't worry the officer might ask you what happened and you just have to be honest. Try a therapy she might know that there is a problem abd she needs to work on it. Good luck and sorry for what you have to go through.

Oh you can apply under 5 year rule if you have been a resident for 5 years. Good luck.

I would file a police report on her and get all the evidence that you can.

You got bruises, show them.

You are emotionally scared then go to police station sobbing, and acting depressed

File all the police reports you can on her

You don't need any evidence of marital problems or a police report or anything. If you have been a resident for 5 years and you meet the continuous residency requirements, then you can apply for citizenship. Nothing in the application asks whether or not you are happily married and your wife doesn't need to sign the application or attend the interview.
