So, my husband and i are separated, hes a permanent resident here, he can live here legally is what im trying to say. We've been together since 2010, and got married in 2011, he came here a little under 8 months ago and we are separated now and he wants to move to another state.

Our relationship was legit, wasn't a fraudulent one. What do we have to do so hes not sent back to his country?

IR-1 ?

Nothing - as that gives him 10 years of presence inside the USA as a LPR - irrespective of marital status after.

If he was a CR-1 - that's different.

sorry to read this misfortune, but you need to check with a lawyer so that you will not be responsible for whatever he does. Question: are you legally separated? you need to got to the nearest USCIS office if you cannot afford a lawyer, mucho expensive..you have already spent mucho dinero to get him here> telepone bills ....So why care if he's sent back. that is not your problem..but you need to start thinking about yourself financially....you are respondible> 8mos are you serious??? you invested 4yrs of time and money. get over the pain and get busy...i am waiting for my husband and we have been talking since 2011 until now 2014. I love him and adore him, but i have a plan of action if this happens to me. ..i have told him i will NOT tolerate this behavior and i he has 3ys according to immigration to become permanent permanet SINCE i am responsible... then i had to lay some ground rules...we have two daughters to get here provided a home and guess what WORK.....Life can be great with the #$#%%#. i hope you will take control and not be threaten by him moving, its a game,,,,GO.....but protect yourself.
