waiver for INA 212(d)(3)

Hello,

My pilot husband was defrauded 7 years ago by a ring of so called immigration attorneys.

Several of his friends also used this service by recommendations of another "friend".

My husband was in Canada, trying to return when he learned his stamp was false. he had to return to his home country. After 9-11, many of the friends

were deported. We were able to return because we were granted an I-601 waiver.

One of the friends now wants to come to US for training in a flight simulator. He will need a waiver under INA 212(d)(3). Anyone have any knowlegde or advice? This friend is not married to a USC, and has no family here.

tia, we can not advise on this. he will need to talk to attorney.

also if he is comming to study here again. he will need to fill out the correct papers

and at the interview they will tell him if he needs a waiver. mean time back at the ranch!

make sure he gets in contact with an attorney. -bye going to sleep now..

Why can't we "advise" on this but can on some other immigration question like a K1 or I-751? Either we can't "advise" on anything becaues of unauthorized practice of law issues or we can give our best public opinion non-porfessional "advise" to any immigration question in the waivers forum since that is what this question is concerning. Just because you or I may not have a decent answer that doesn't mean someone else in the collective "we" does not.

Not sure if he needs a B or a F1.

But presumably this is to keep his certification up, I would suggest a word of his Employers Immigration Lawyer.

I have seen someone obtain such a waiver, must admit I was very surprised, so it's doable.

The I-192 is the form needed for the non-immigrant waiver. It can waive almost anything but is discretionary. No family ties required. If the friend was deported, he may need a I-212 if it was less than 5 years ago, not sure about that though.
