K-1 Visa Process in Mexico

Hello friends!

This post is to give my experience so far as to my K-1 Fiance Visa! I am just days away from my Medical Appointment and my Consular Interview but I wanted to share so far what my journey has been! I hope it helps and I will try to be as detailed as possible!

So let me begin with some background info; like many of you may have, I met my Fiance is the US when we were still in high school. I was a Senior and she was a Junior...when I graduated high school, I was accepted to many universities but of course, due to the lack of money I was unable to attend even a Community College because my family is low income and I was unable to find a job...I lived in the US for 18 years and I came back to Mexico because I wanted to continue my education. I never thought my GF would stay with me but we have been together in a long distance relationship for almost 3 years now and if my visa is approved, we are getting married exactly on our 3yr anniversary!

First: We filed the petition (I-129F) to the TSC on February 8 and we received the confirmation on the 12th of that same month stating they had received it and provided us with a receipt number. It was fast!

This is what we sent in that I-129F packet:

1. Payment as required by USCIS. Use a personal check so you can track the payment. Money Orders are also accepted. 2. Cover Letter (see example). Should include a description of what your are petitioning for (I-129F), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet. 3. Form I-129F: Petition for Alien Fiancé(e) (see example) 4. Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it. 5. Original statements (from both the US Citizen and foreign Fiancé(e)) certifying an intent to marry within 90 days of entering the US on a valid K-1. (see example) 6. Proof of having met in past two years. (click here for examples) 7. G-325A (all four pages) filled out by the US Citizen signed and dated (see example) 8. One passport-type photo (see specification) of the US Citizen. Write the full name of the US citizen on the back. Place in a plastic bag and label the bag "Photo of <Insert US Citizen's Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a. 9. G-325A (all four pages) filled out by the foreign Fiancé(e) signed and dated (see example) 10. One passport-type photo (see specification) of the foreign fiance(e). Write the full name of the foreignFiancé(e) on the back. Place in a plastic bag and label the bag "Photo of (insert foreign Fiance(e) name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a. 11. Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship. 12. Copy of final Divorce Decree(s) or Certificate(s) for the US Citizen and/or foreign Fiance(e) if either has been previously married. If the previous marriage of the US Citizen and/or foreign Fiance(e) ended due to the death of their spouse then include a Copy of Death Certificate(s) documenting that fact. 13. Proof of Legal Name Change if either the US Citizen and/or foreign Fiancé(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order. 14. In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information.

We received the NO2 on May 12th and from then we started gathering all info that I would need for my interview.

First:

1. I filled out form DS-160 (it is required to have your passport)

2. I started gathering documents such as Original birth certificate, Police Records (although for Mexico it does state they are unavailable on the state.travel.gov site) I was able to get one for my specific state (Estado de Mexico) and I cannot say whether or not they will take) Passport etc...you can find this on the Ciudad Juarez Consulate site

3. Had my fiance fill out the Affidavit of Support and since she does not make enough, we also had her father help us out and fill out the form too

4. My fiance was able to get her tax return and her dad's, letters from the bank addressed to the consulate stating all the bank account info, letters from their employers and signed stating how much they make and recent pay stubs

5. She sent me copies of her and her dad's proof of citizenship (passport and birth certificate copies)

6. A new letter of intent signed and dated much closer to the interview date (June 18th)

7. An entire copy of the I-129F packet

8. Proof of relationship: I printed out her new ticket since she is coming again on July, old passport stamps and tickets from previous flights, wedding plans such as wedding guest lists, venues we have looked at, pictures we have together, new letter of intent, and more options

ASC Appointment:

For the ASC I went this past Thursday and the way to set up this appointment, you have to first have your passport, fill out and print form DS-160 after you received the letter from the Consulate and then pay the MRV fee of $240.00 USD for K-1 in this case. Once you have done that you can call or set up your appointment online or by phone. Once you have the appointment set up, you will need the printed DS-160 and the confirmation of appointment from ASC (you will get when you pay the fee and set up appoinment) and show up at the ASC you chose 15 min prior to your time since they will be letting you in based on times not on who is there first. Once you are in there they will scan you form and passport and tell you go to to a window where they will again scan the paper, look you up, take your pics and finger prints and you will be out of there in no longer than 20min!

I have prepared my packet like it states on the Ciudad Juarez consulate site and i will be traveling to Juarez this Sunday! and my interview is on Wednesday June 18th!

Who received the package 3 (letter from the embassy) you or your fiancée?

How long it took to receive the letter?

In my experience my fiancé received the letter first, then about 2 weeks later I received it myself and was able to finish setting up my appointments and such ?

I'm getting nervous, since May 30th the CEAC status appears as "ready" but the famous invitation letter has not arrived.

I dont know if it has not arrived because the embassy still has sent nothing to us or because the Correos de Mexico service is too bad!!!

Well the letter of invitation should arrive at your fiances house first, then you will get a copy of the same letter but addressed to you and it will come through Correos de Mexico. Call the consulate to ask them about it if you have not received it.

The CR-1 spousal visa process is not the same as the K-1 fiance(e) visa process. You are following the wrong instructions.

Oh good. Your profile and timeline confused me and I was afraid you were following the wrong instructions. Very rare to see a K-3 approval and go through nowadays. Good to know you are indeed going for a K visa after all. Good luck! :)
