AZ SB 1070 and out of status

Hello,

I entered the US on a K1 on March 21st. We have subsequently got married and filed for AoS and EAD.

I believe I should hear back about one or other in 6 weeks from now.

My i94 expires this month on the 24th.

My understanding of AZ SB1070 is it requires lawful aliens to carry documents proving they are allowed to be here.

Originally I carried my Passport, then once I got my driving licence I carried that (as you cant get one without valid status).

Both of these forms of ID are valid till the 24th of this month.

I am unsure what I am supposed to carry with me now.

I have the I-797C (NOA1?) from AoS, but that has largely printed on the top "Does not grant any immigration status or benefit".

Can anyone suggest what ID I should carry on me?

Thanks!

Generally, an NOA letter is sufficient proof of status. Technically, after K1 expires you will be out of status but since you are filing AOS you are considered AOS in process. Of course, you cannot obtain or renew a state license until AOS concludes but it is not big of an issue elsewhere. You can probably carry your passport and show I-94 showing valid and legal entry, coupled with NOA showing a pending AOS petition. All these documents taken together can prove valid and legal presence in the US although not specifically included in the enumeration of forms of IDs on the SB1070 text.

Sein oder Nichtsein, das ist heir die Frage.
