Hi! I called USCIS today, because it has been over 5 months and I still have not received the NOA2. I asked to speak to a Tier 2 representative, but apparently, the customer service rep didn't understand what me or something. She told me my case was outside the normal processing time, and that I could put in a service request. She asked me two questions, and then changed her previous statement and said my case was in fact inside the normal processing time. When asked why the USCIS website states the NOA1 to NOA2 process is up to 5 months, she said there was a backlog at Texas, working on December 3rd people, and to check back in 37 days from today. Well....hate to break it to her, but 37 days from today is only 30 days, not 37. Then she said I could schedule an InfoPass at my local office to get more in-depth information about my case then what you see online. I tried that, but none of the reasons listed pertained to me. I loved her inability to do simple math, her misinformation about the InfoPass, as well as her not comprehending my request to speak to a Tier 2 representative.

My question is this: To those Texas filers....the ones who are still waiting for the NOA2, have you filed a service request? Who have you spoken to? What to do next (besides wait until the end of time for them to get their act together)?

The best way would be to do a senatorial inquiry. They have to respond to that and though it won't be adjudicated necessarily faster,

it just may just help a bit Infopass is a waste of time and a tier two wouldn't be much of help either at this point.

If you want to talk to Tier 2 you must be assertive enough and push the issue and don't let some ding bat answering the phones derail you.

Have you tried submitting a request online? That seems to have worked for others. I'd also be persistent & keep calling if I were you. That's what I plan on doing in September. Call everyday & contact every representative who could possibly help my case. This wait is insane & I miss my Matt like crazy.

Google your senator's web site and fill out the privacy release form online or ask them to fax it to you, sign it, return it, ask them

to inquire about your status and that you are out of processing time. That's all.

Passing the 5 months average processing time gives you the right to call the USCIS customer service line. The first thing they check is the specific service center's current processing date. If that date is after your NOA1 date, then you are allowed to submit a request for additional information. I called them today also, the good news is when I called them two weeks ago, the processing date was Nov 16, so they are now at least keeping up with the calendar - I think they know they're behind and are starting to pick up the pace. Had they not been keeping pace with the calendar, I already have a letter written for my congressman, but as is I'll give them another month.

that said,

TSC hasn't had more applicants than other service centers; in fact they've wiped most of their historical data - which you can DL on the USCIS site. The numbers that are left, don't add up in terms of applications and numbers processed, and using my NOA1 date, their backlog at the time, and projecting with their monthly processing numbers suggests that processing to NOA2 should have taken just over 3 mos. Unfortunately all the data ends in March. VJ does show several couples TSC has processed since mine, and country of origin seems to be a strong factor whether they grab a packet sooner then their "processing date".
