Complicated I-134 Affidavit of Support for K1 visa

I'm preparing the documents to send my fiancee once we get NOA2 and have a question on the I-134. The form is pretty simple, but my situation is a little complicated, so I'm hoping someone can offer guidance.

It states to provide copies of pay stubs or if self-employed last income tax return.

As of March this year, I'm no longer an employee of the company I work for, but am now an owner and officer (along with one other owner/officer). As such, I no longer receive "paychecks" (instead, I take a share of income, which is only reported at the end of the year on a schedule K form), so I have no recent pay stubs. And since this change was recent, my last income tax return doesn't show this. So I can't really submit either forms of their required evidence.

So my question is, would a letter from the other owner noting the change in company ownership/employment suffice the requirements? Anything else I should submit to show that I still get paid?

Thanks for any advice!

Did you file taxes for 2013? Do you have something like a W2 or some other earnings form? If you take home a share of income - it must be by check or direct deposit?

It would help to get a letter from the "owner," stating exactly how you're paid, approximate annual income, length of service, value to company, etc.

You can also provide documentation pertinent to the business arrangement.

As long as you can provide proof of your income, which can be validated with bank statements and your income tax filing, you should be fine. I would suggest that you attach an explanation of the situation to your I-134 form.

Don't forget to include bank statements, a letter from your bank...and, you might be able to provide a letter from the bank that handles your business transactions, too. As long as you have signing authority. As an "officer" of the company, I would imagine that you would.

Good Luck!

Thanks for the guidance! I'll prepare as much as I can and ask the other owner to provide a letter with the pertinent info. Hopefully that will suffice for the "powers that be!"

You only need your most recent 1040 tax return(s). Since you were an employee last year, then include your pay stubs from last year. Your recent change to owner/officer doesn't really apply, since it occurred March of this year.
