Good day everyone! Can anybody assess my profile? I already submmited my application for a tourist visa and scheduled for an interview on July 16, 2014.

My profile:

>Single

>Currently working in Dubai for 1 year

>Bank Savings (little amount)

>Parents both US permanent residents. (Senior citizen)

Here's my scenario, My parents arrived in US last november 2013, mother filed a petition for me last January under f2b. Father left in the US last Feb for his job. ( He could not afford to give up his job). Mother stayed in US to spend more time to with relatives and friends ( currently staying in my aunt's residence). Now my mother wanted to go home for good, she doesnt have intentions of staying there permanently as the rest of the family are in Philippines, since my Father is currently on 1 year contract as a seaman he asked me to accompany my mother on her travel back home and he will shoulder all the expenses. Will be staying in US for 20 days. What are my chances in getting approve since I declared it on my application that somebody filed a petition for me.

Thanks in Advance!

Hi,

No one can tell you what your chances are. Each case is considered based on the unique circumstances of the applicant.

On some other notes.

Your father is risking losing his green card. He is living and working outside the US. A green card is for living and working in the US.

Also, as a green card holder, he must file US tax returns on his worldwide income. Did he file a US tax return for 2013? If not, then he risk losing his green card.

If your parents both go back home, then they risk losing their green cards.

In addition, family based immigration is about family reunification. There is no reason for the US to give you an immigration visa in 7 years when your parents are living outside the US.

YOU NEED TO READ AND EDUCATE YOUR PARENTS ON MAINTAINING THEIR GREEN CARDS. http://www.uscis.gov/green-card/after-green-card-granted/maintaining-permanent-residence

Thanks for your response. Actually im not hoping for my f2b petition anymore since it will take years before youll be given a visa. As far as I know both my parents filed for their tax. My mother will file a re entry permit before she will depart US just incase, but most probably she wil spend more time in the philippines than in the US so there is a great chance of losing their green cards.

why would they risk losing their GCs after just getting them? Who would believe that?

As to your chances, I would guess around 5%...too short a time in Dubai, obviously away from your native country, at least one parent residing in the US (in spite of the stories to the contrary)....young, single, not well established in your career, and from a country whose willingness to adhere to our visa laws is spotty at best.

where does your brother (or sister) live in the US? (the American citizen son or daughter who petitioned your parents)

my mother was petitioned by my aunt. actually they are supposed to emigrate in 2010 but due to their unsure decision they were affected by the retrogression. then just last year they arrived in US. great chance of losing their green cards is that my father is not giving up his job. he doesnt like to start from scratch in us and since father doesnt want to stay permanent in the us so there is no reason for my mother to stay permanent in us as well. my brothers and sister and my parents grandchildren are all in the philippines... they just grabbed the oppurtunity last year for my mother to at least visit and experience america. both parents are in their 60's.

It will be much easier once/if your parents give up their greencards and leave. The fact that they applied for a greencard for you makes it look like you're trying to skip the line and join them.

Sounds like the tourist visa was correctly denied for immigrant intent, then - can you confirm if it was a 214b denial?

The reason why they denied my tourist visa before was lack of funds. Doesn't matter if you have pending petition or not. Its how you convince the officer that you have enough funds to cover your travel expenses in the states.
