Hey guys,

I finally got my interview notice for Atlanta at 8.45am on July 11th. I got the notice in the mail today and there is one thing that sticks out that is dis-concerning...

"Letters from each current employer" for each of my sponsors.

My co-sponsor is my father-in-law who wasn't particularly keen on helping us in the first place and is a really private person so it was like pulling teeth trying to get him to provide any documentation in the first place.

I have: his past 4 years of tax transcripts (making 80K+ consistently) and a photocopy of his birth certificate (which is what I submitted with my application, received no RFEs)

For my wife, I have: 4 years of tax transcripts, birth certificate, letter from current employer, letter from previous employer, last 6 paystubs from previous job and last 4 paystubs from current job.

What happens if I can't get him to provide an employment letter/paystubs? Can my case be denied because of that?

I know that when submitting the initial AOS application, paystubs and a letter weren't considered "required evidence" just suggested to avoid an RFE, but then in the letter it says "A completed Affidavit of Support with all required evidence (unless already submitted)" and then proceeds to list those two things on the second line.

Did anyone else have issues with this or do they look that much into it? I'm not sure what I can do. Or if I'm getting confused by the wording.

Proof of current employment is required, either a letter from the employer or 6 months worth of paystubs. That should have been initial evidence for you, but sometimes if the job is longstanding they will accept it without.

If they want to see proof of current employment at your interview, and you don't have it, they will issue you a RFE.

It is long standing and all his tax transcripts are consistent from an income of over 80K annually each year. I'm just not sure what to do because I feel like I should have gotten an RFE for my I-864 if they didn't feel like it was sufficient, even though I know they can issue RFEs at any point, the ones for the I-864 usually pop up pretty early in the process.

On the letter is also says 2 months worth of paystubs AND letter of employment, not or.

Neither of those things were listed as required in the initial packet, just suggested. I sent everything and more in for my wife's sponsor documentation though just because I could get it with ease.

Ahhh, stressing out.

We were not required to present that at the interview. She just asked my husband if he was still employed at the same job and if he filed taxes. We offered current stubs but she said she didn't need it cos she already had the i864 from when we filed.

That sounds stressful. I would definitely get it and bring it, especially because it says. "And". Sucks.

Others with more experience can answer the "what if you can't get it question.

You can choose not to bring it, and if they ask for it, then you get a RFE.

There is a good chance they won't ask for it.

But, you can't claim it isn't required or something, it is required. I think your I-864 is provisionally accepted at this point, and there is a good chance they won't ask for proof of current employment.

I haven't really read of any couples who had their IO ask for letters of employment for their co-sponsors, just tax transcripts/returns if anything. Of course I am going to ask him, it's just a matter of if he sees the urgency or decides to be compliant.

I understand that in the letter it is put under required, yes. But in actually submitting the I-864, all they required was proof of US citizenship and the most current year of tax transcripts. Letters, paystubs, and extra transcripts from previous years were just suggested in the instructions, but I did submit his last 4 years of tax transcripts because he allowed it.

I don't know, I just want this interview to go really smoothly and not have to wait any longer.

IMHO the interview letter is a form letter that is sent to all applicants. My husband and I panicked when we read that we needed birth certificates for each of our children. My husband made special arrangements to get the birth certificates and the officer did not ask to see the birth certificates. The officer only wanted evidence of our bona fide relationship.

Don't mention the employment letter during the interview. Only respond to the officer's questions.
