You missed the boat on changing the name by not filing AOS in the married name. The name is legally changed now if that is the name she wants, she just starts to collect IDs in the new name and a GC is the best and first one to get. But, you did not do that.

Once you get the GC, you can pay to get the name changed to the married name, or you can wait until ROC and do it then for free.

If you are selected for an interview, then you can try to change the name before the GC is produced.

Plenty of people here willing to help you with that, had you asked.. Good luck.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Ok ok. so I can resubmit the forms after I receive NOA1 for the AOS. and just put my last name as her last name ( even though it is not official)

or, as in another response to my post, if we have an interview, i can request it then.

they also mentioned wait till ROC and I can change it for free. What is ROC?

or after green card is given, i can pay the enormous $450 fee to change it...

THANKS FOR THE HELP YALL!

No, you cannot resubmit the forms. You already missed your chance on that. Not trying to be mean, just trying to be clear.

ROC is Removal of Conditions, the next step after you get the Greencard. You will need to show in 2 years that the marriage was entered in good faith. Form I-751.

Down the line a year or so, if you apply for citizenship, you can also change your name legally and for free then as well.

Thank you, goodnight and may your gods go with you",
