We got married back in march this year and file for my I-130 in april from abroad. End of May, we decided to go spend the summer in the US. It's has been just under 2 weeks, but we don't think we want to go back... We still have our apartment overseas, with internet, cable, electricity, etc... We just rented (on monday) a small place on a month to month basis to spend the summer here, but like I said, everything of ours is still in our portent overseas.

If we submit for AOS, would that be considered intent to stay and get denied?

Jan 30, 2015: GC received.

 

ROC:

Nov 5, 2016: Mailed I-751 & documents

Dec 9, 2016: Biometrics appointment

 

N400:

Yours is a grey area case, but if you are speaking the truth and did not intend to stay when you entered the USA, then I think you will be ok.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
