Individuals may qualify to participate in NEXUS if they are a citizen or permanent resident of the United States or Canada who pass criminal history and law enforcement checks.


However, individuals may not qualify if they:


  • Are inadmissible to the United States or Canada under applicable immigration laws;
  • Provide false or incomplete information on their application;
  • Have been convicted of a criminal offense in any country;
  • Have been found in violation of customs, agriculture, or immigration law;
  • Fail to meet other requirements of the NEXUS program.

To participate, both the United States and Canada must approve an individual's application. Denial of an application by either country will keep an individual from participating in the NEXUS program.

Small update on my waiver. I drove 5.5 hours to the border in Maine on May 1st. I had all my documentation, paperwork to submit my 212 waiver. It was a 4 hour ordeal and the CBP officers thought I needed to file a I-192. I was even asked multiple times if I had a criminal record when my RCMP Livescan was right there saying I had none. Finally after many phone calls and 2 supervisors later, I was fingerprinted and my waiver was submitted.

I had a letter of offer of employment from my friend's US company and a letter of reference from the police chief (friend and long-time customer of the US company).

I still haven't received a reply to this day. When I ask for an update, I get a response saying my application is pending further review. I guess it's better than a No. Fingers crossed I will receive a response soon!

My friend also started the process a year ago by submitting a PERM application for me with the department of labor to sponsor me on a H1B visa. I'm sure they saw this application during the review process for my 212 waiver. I hope it doesn't play against me. As I stated in an earlier post, I learn from my mistakes and am now going about the right process in order to legally work in the USA.

Odd it should take that long, does the Lawyer think there is a specific reason?
