Not trying to pry. But wow. A family of 3 making over $45,000 qualifies for Medicaid? That doesn't seem to make sense.

under the table income? working as a contractor? etc... Hard to say how this is being played.

How does your husband have a job if he is here illegally?

You said he got a Conditional Permanent Resident card. Was that claim a mistake? It seems like it, but please clarify what you mean by that.

Your lawyer is mega stupid.

I have a job also, My lawyer said that my income wouldn't matter. I told her about what I read online that said I would have to be able to prove that I can support him. I told her that I could and she says not to worry about. Getting the information that I am getting from you guys is making me question everything she has said to me.

How much do you make at your job, Ram?

You show you can support the immigrant by proving that you have a qualifying job, or by showing assets. It's not just a random promise, you have to show a certain amount of money. It's all laid out in the I-864 form.

When you talk to your attorney on Tuesday tell her she is an idiot and doesn't know anything about immigration. Ask her about the income requirements and if she planned on being your joint sponsor. When she says no then demand your money back.

You have to prove you make at least 125% of the poverty level for a household of three or that you have 3X the assets to make up the difference or you have to have a joint sponsor. And the income must be from a legal source. Since your spouse is working illegally his income doesn't count.

She was just quoting from other people she saw posting here. Her husband has no card. It confused me also, and I already asked.

I totally agree with your lawyer statement. Some might say criminally stupid.

As to the husband working, I certainly hope he's never made claim to being a citizen. That would really muck things up.

No he does not do anything illegal at all. And he does not get paid under the table. He gets a normal check just like a citizen would. He isn't working under anyone's social so he is just working illegally. His boss knows that he is illegal and is also willing to help him become legal. I make about $32,000 a year.

I also called another lawyer's office just to get some information about filing immigration and she even said that the information I had was wrong.

I do not know how I didn't get this sooner.

I really do appreciate everyone's comments. Thank you guys so much!

If you make $32K a year then you qualify to be the sponsor.

I am not sure how you qualify for medicaid, though, with your combined household income at $77K.

I did read the guides and do see that I qualify. Apparently my lawyer should go back to law school or something. She claims that she's never had anyone get denied before. And I have medicaid because mine has not yet expired from when I had it when I got pregnant. Our son automatically gets it.

i have one other suggestion - before you fire the lawyer - or make hints of firing the lawyer.

ask the mexican girl there for a complete copy of your file.

then once you get a complete copy of your file - study it - looking for formletter I-797 or I-797-C.

if it's there - it's been filed with USCIS and there is a receipt number.

if it's not there - then it has not been filed with USCIS.

THEN - fire the lawyer. get the complete copy first. you can probably swing by the office now since lawyer is gone and get the mexican girl to make a copy - but don't tell her anything about what you are going to do with it - tell her it's simply for your records and nothing more.

the main reason for getting the copy (well there are two)

1. if nothing was filed - is easy to transpose onto a new, blank I-130 form and

2. if something was filed and there is a receipt # - then is dead easy to chase after the I-485 quickly.
