Im sure she is a legit lawyer. I have been to her office several times. My only thing is that she may not know what she is talking about when it comes to immigration. She even has an assistant thats mexican and she told us to about being married for two years but believes that being that we have a son and had so much proof that they don't think we will get denied.

Ditch the attorney. Try to get your money and all your paperwork back. When you go to file do it from the USCIS.gov website. There are scam websites out there (of which I think you found one) that will "prepare" your case for you. They are just charging you money to do what you can do by yourself.

Again, read the guide on this site. Use only uscis.gov for your forms and instructions. Don't use a preparation service. There is no filing online or having a person assigned to your case. You do it yourself and mail everything to the place on the instructions.

You cannot file online. No one is assigned to help you.

You got a lot of reading ahead. You need to read the GUIDES (more than twice IMHO) and the instructions for all the forms. That should take at least a weekend. Not easy stuff to digest, but doable if you have the patience to read them all and are fairly good at putting it all together.

Specifics. What do you mean?

There's lots of government assistance. Depending on the assistance and who received it, it could matter.

Who received the benefits?

Did your husband received or benefitted from any of this government assistance?

You will need to have income above 125% of the poverty level or a joint sponsor to adjust his status.

You will need an income at or above $24,737 for a family of three to meet the income guidelines to adjust his status.

You and your son, as US citizens, are entitled to use Medicaid. It's not a problem for your husband to adjust status.

As Caryh pointed out, you do need to meet the I-864 financial requirements. Since you are getting Medicaid, you are unlikely to meet the financial requirements on your own. Do you have a Joint Sponsor - a USC or LPR who will take financial responsibility for your husband if he does receive a means-tested benefit?

There are probably a few new terms for ya - Joint Sponsor and means tested benefits. You'll find out more in your reading.

correct me if i am wrong . but whatever your husband earns at this point is not a valid source of income at least on Immigration point of view since he is considered "illegal" to work here in the US......

maybe he can ask his USC family , friend, or boss to be a joint sponsor when you file ...

August 11 2014 - Received I-797C (Biometric appointment scheduled for August 22, 2014)

August 12 2014 - Walk-in Biometrics successful (Orlando Office)

August 14 2014 - Requested USCIS hotline to expedite EAD

August 18 2014 - Received email from USCIS to submit pertinent document to support expedite EAD

August 20 2014 - Submitted "Job offer letter" via fax

August 25 2014 - I-765 EAD moved to "Production Status " and will be mailed within 30 days

September 5, 2014 - Advance Parole and EAD combo card received in mail

I have no idea what that mean but my husband does have a job and makes over $45,000 a year.

Your husband is working illegally. While this can be forgiven when married to a USC, I'm not sure how well its going to play when you say you're depending on the income of a job your husband cannot legally have when you're asking the government to give him permission to live and work here legally.
