Your wife will probably get the GC and you will probably be responsible for her until she becomes a citizen. She came here on a fiancé visa to marry you, which I'm assuming she did. Why wouldn't they give her a GC and hold you responsible since that's what you signed up for?

Because she used him to gain entry into the USA which is fraud. She was clever enough to get married and now wants to use her status as such to get the G card. Once she has done that she will begin to leave the USA to return to Thailand especially if she thinks Slowlyman will have to support her in some manner. She will use her status to elevate her status and income to indicate to her family she has done well even at the expense of the man that made most of this possible. That alone should be an snapshot of what her initial intentions were. She never intended to fulfill promises she made including marriage.

As Thai I am ashamed of this type of person. There are many that I know that would love to have a man dedicate himself as I have seen Slowlyman do.

The earliest Infopass I can get is the 26th. Guess I need to start a letter writing campaign.

I wonder how else I could get the language in front of the adjudicating officer.

Uhm - email into the ILS Human at the congressman's office -

with a special request to ask the adjudicator to stop and review the LAW that I posted, along with a request asking for supervisor (the adjudicator's supervisor) review prior to any further adjudication work.

I thought that was obvious - really !

The ILS human has said she has done all she can for me. She suggests I contact USCIS myself.

Nope - the response via email clearly indicates a screw up and now the need for another 'reach out' is needed. She's not doing an inquiry - she's doing a reach-out. Not the same thing.

There is also the option of attempting this through another legislator's office. You have two senators and one congress person for your district.

i disavow the use of this option - stating it's better to use the same human until resolution is obtained. Usually a constituent liason at the Congressman's office starts the convo with, "Have you sought help from another Congressman about this issue?" then will refuse to assist if the answer is yes.

it's also quite possible the ILS human needs some training as well - by the OP - as to the exact issue and exact reach-out.

This was not my experience the one time I used two of them, both congressional and senatorial. Both put in an inquiry, and both got an answer. But the senatorial reply came after my wife's green card was approved, so they were rather slow, while the congressional called me, and kept in touch through the entire process, even double checking afterwards to insure we got it. I'll agree sticking with the same one is best, but if he's being shut down by one, he may have little other choice unless he goes to another. And I've seen many people who had to jump to more than one to get any help whatsoever on an immigration issue.

I wouldn't be happy with the ILS human who suddenly says do it yourself. Given the time available, I'd be attempting to hit him up one more time, while also attempting to open the path with another ILS in another office, just in case I couldn't make it work with the reluctant first ILS. But hopefully the Adjudicator gets proper instruction from inside USCIS before issuing the green card and pulls the I-864 as he should.

I did as Darnell suggested regarding the ILS human. The response was. "I'm sorry I can not help you any further with this issue, I suggest you review USCIS.gov website".

I did contact another Aide when the 129 process started. I will reach out to her on this.

Additionally, a new withdrawal letter included the language posted here went out to the Field office today.

Were you able to get into the field office? Did you have an info pass? Were you able to hand the documents over to someone?

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

my local office had a drop box - but i think you need more than a drop box.

Divorce does not end the obligation under the I-864. If he does not get it withdrawn he could be in hock to the US government for the rest of his life paying the government back for any means-tested benefits his ex-wife receives. If she gets food stamps the government could sue him to repay the amount. If she receives medical care under Medicaid the government could sue him to repay the costs.
