I'm filing the i 864 for my parents. My W2 is not enough so I'm using my husband's (who lives with me ) income. He will fill the i 864A. Since we file our income tax together (joint income tax) do I put my income from my w2 in question 13 or do i put our income together on question 13. Also when i fill out the i 864 A do i put his income from his w2 or our income together?

I-864 - You put YOUR income on Part 6, item 5, your spouse in item 6c, your and your spouse's TOTAL income in item 10.

Item 13 must consists both your and spouse's TOTAL income as it appears on your RETURNS TOTAL INCOME.

I-864A - Part 1, Item 10 will be your spouse's income. Item 11 must consists both your and spouse's TOTAL income as it appears on your RETURNS TOTAL INCOME.

I am the petitioner but I am a stay at home mom and we file our return jointly.

How will I categorized my I-864? Affidavit of support submitter? 1st joint sponsor?

no, you are the sponsor, your husband is the household member

the petitioner is always the primary sponsor

remember it's an i864 and an i864A for each parent, parents are filed separately so your husband has to make enough to cover everyone, since you don't work

Right now we have 4 members in the family then we have to add the parents.

Is there a minimum income requirements to petition both parents?

For each parent? My understanding is only one form is used if the otther family member is immgrating at the same time or within 6 months of the principal immigrant.

In my case my father is the principal and my mother is listed in Part 3 Item 2. Isn't this correct?

Yes, though I've seen some people use I-864 for both and also per VJ Wiki, use I-864. I'm using I-864A for my husband. It was easier to fill-out. :blush: I'd say, complete I-864 and read through the instruction and do what makes sense to you. As for me, complete I-864A made more sense.

You are the petitioner, you must submit an I-864, as the primary sponsor, and your husband provides the I-864A as the household member sponsor.
