Not sure if this is the right forum, but we are now at the NVC stage of the process.

Question Summary: Will I be OK with reporting on AOS the current submitted tax return the IRS has, even though in the next couple of weeks/months, the adjusted gross income will be increasing dramatically when my tax preparer files a correction to the taxes?

Question DETAILS below:

For our AOS, we have to submit our typical tax information, W2s, etc.

The issue is that since my of my work was in Mexico, my company has a professional Tax preparer do my taxes to equalize taxes paid to the US, vs. the lack of taxes paid to Mexico. (usually for my situation, there is little net difference between doing taxes normally or doing them this way due to the travel).

Often to meet the tax deadline, the preparer submits a tax return, knowing I'll be getting a W2-C (or corrected W2) later in the mail. This happen last year, for a few dollars difference in wages, and the IRS noticed, questioned it, and we replied back with an update to them and all was good.

This year however, the W2-C was recently sent to me, and the difference is HUGE (40% increase reported in my salary) So, the wages that were reported to the IRS this year are going to change dramatically in the next couple of weeks while my tax preparer is adjusting the amounts.

Will I be safe submitting my AOS today with what the IRS currently has in their filing? (i downloaded my IRS transcripts as recommended for submission which have the non-corrected W2 amount, so I would assume this is the way to go. )

i see two choices here:

1. hold off till you have the new stuff or

2. submit what you have into NVC - then make a new I-864 set to hand over on interview day at the IV Unit.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

You should be able to submit to the NVC whatever you have now, and then when your spouse goes to the interview, provide an updated I-864 to bring with them.
