On the visa application Form DS-230 (expires 7/31/2007), you saw the following offer:

"Do you want the Social Security Administration to assign you an SSN (and issue a card) or issue you a new card (if you have an SSN)? You must answer "Yes" to this question and to the "Consent To Disclosure" in order to receive an SSN and/or card."

Please note that this program is ONLY for Immigrant Visa holders (CR-1, etc). If you checked this box, a Social Security number will NOT be generated for you if you are a K-visa holder. As a K-visa holder, use the following guide to get your . . .

This is out of the FAQ/ "How to" section. Where is the proof of this? Quote the applicable USCIS instructions or Statute that backs up this statement.

Yea.... I just did the paperwork..and I checked this box... I need to know what to do when she gets here..as we need to get married..with the SSN... Do I wait..or Do I just go get it.. ?? Facts pls.. :)

Note DS-230 is an application for an IMMIGRANT visa and immigrants that enter the country on a CR-1 or IR-1 get green card automatically after entry, and as such also directly qualify for a SSN.

K visas are non-immigrant visas requiring adjustment of status to that of an immigrant after entry, K-3 visas need EAD or Green-card in order to apply for SSN, K-1 visas are considered to be work authorized for only 90 days after entry, and can apply for a SSN at the SSA office with in that 90 day period, after that thay too cannot get SSN until they have EAD, or Green card.

SSA won't issue SSN automatically to K visa holders because they are not considered to be immigrants.

Checking the box on the DS-230 will not get a SSN issued to a nonimmigrant, only immigrants.

As soon as your fiancee arrives wait 2 weeks for SSA system to be updated then visit the SSA office, and apply for her SSN, K-1 visa holders can get a SSN with in the 90 days of the I-94. SSN is useful for other things like banking.

print it out and bring to SSA office, you can point out part C where it shows K-1 as being able to get a SSN.

Note that DS-230 is a Department of State form, not a USCIS form. You won't find USCIS having anything to say about the matter.

Note also that the SS card item is on DS-230 Part II. Most consulates use only DS-230 Part I (Biographical Information) for the K visas. Part II (Sworn Statement) is not necessary for K visas, the significant items being sworn to are covered on I-485 for adjustment of status.

You might find something on the SSA web site - the item deals with them.

The referenced link is only about Visa classifications that are AUTHORIZED to WORK. K-1's are also on the list. Says nothing about SS Card.

Where does ANYTHING say that only CR-1 or IR-1 get a SSN by checking boxes 33a and 33b on Form DS-230??

Not True. BOTH parts were REQUIRED in Moscow for a K-1 applicant.

Well, when you fill out the DS-230 go ahead and check the box. When your fiancee gets here and after a year or two her SSN card does not arrive then you might realize that the answer in the FAQ was correct.

Things do change, this forum doesn't. I got my approval WITHOUT any IMBRA related issues, but no, that would disturb the OLD knowlegebase. Far be it for things to change and actually get better in the process. Then the old stick-in-the-muds couldn't go around sounding important all the time.

Wow - strong words.

This topic has been discused again and again - there was just a post this week from someone asking why he never received his SS card EVEN THOUGH HE CHECKED THE BOX TO HAVE ONE SENT. He ended up having to go to the SS office to get one.

He didn't get it because it doesn't work that way for K1s. Right - they are immigrants. Immigrants who have to go to the SS office and apply for a SS card.

"List of Documents for Fiancé (e) Visa Interview

1. Biographical form DS-230 filled out in English (part 1 and part 2). A separate form must be filled out for immigrating child over 16 years of age."

There is a reason for this statement on a government site: "A Fiancé(e) Is Also an Immigrant "

Now as to your dilemma, have they already accepted only 1 part of your DS-230? if so, what was the date of the interview? Which consulate? or are you just making an 'assumption' that they won't take the complete form??

Right, great. But that does not mean your SS Card will be sent to you, even if you checked the box.

Don't you think if something had recently changed, it would be all over the forum?

Well I was bored since wife was watching American Idiot, so started reading these things and people like this guy are why I quit and don't miss it.

I'm with you - I'm sick of trying to help people through this process and then get treated like #######, or see other knowledgable, helpful members, get treated like #######.

A Fiancé(e) Is Also an Immigrant

Because a fiancé(e) visa permits the holder to immigrate to the U.S. and marry an American citizen shortly after arrival in the United States, the fiancé(e) must meet some of the requirements of an immigrant visa.
