Hi...my name is Barbara. We submitted our I130 in March 2013 finally got approved right before the holidays last year. Since then we've jumpef SO MANY hurdles its ridiculous. We now are waiting for approval from NVC after receiving our 3rd checklist. Our lawyer seems to think this time it will be accepted- we hope anyways. My new concern now is that all this time our lawyer has told us we will need both the I 601 & I 212 waivers "extreme hardship"...are both of these waivers submitted the day of interview? Last night another member here told me I'm probably looking at another year...this statememt has had me up all night...does anybody know what the process is and if it really is going to be another year? Help...please :-(

hi

the waivers are sent after you are denied a visa. you will receive a letter stating based on why you were denied and then you send the forms, paymentas plus your husband's hardship letter

now can you give us details on why do you need both waivers? were you deported from US?

Thank you so much for responding to me. Yes, the my husband was voluntarily deported back in 2006 and received a 10 year bar. When I originally approached our attorney with all the details, he told me that we have a very good chance of qualifying for a hardship waiver. So like I said all this time we been working on everything else and now that I know we are hopefully about to get our I864 approved and obtain an interview date, I'm starting to think that this just seems too easy. My attorney has told me that he will submit and pay for both these waivers at the actual embassy at Ciudad Juarez and hopefully get approved and WALAH!! But somehow the more I read what everyone in these forums are saying I'm staring to feel very negative about it all. Do you or does anybody know if this procedure my attorney speaks of is valid? I hate to doubt his word but it's been over a year now that we've been waiting for an interview date. DESPERATE :-(

When he finally do the interview, the CO at the embassy will deny

the visa and issue a 221G (an approval to file waiver) if he qualifys

any first yr immigration atty should know that these waivers are filed

to the lockbox in Ph ,AZ where its sent to Neb for adjudication, so U

have crossed the 1st hurdle USCIS, its now on to DOS=embassy,

after the interview waivers are sent in by your atty who should prepare

a brief for the package, U will write an hardship letter to include YOUR

hardships, Y he has to come back & U cant go to his country to live,

also U can argue crime stats there in his country, substandard medical

care, U not speaking the language etc, letter from your pastor of your ties

to community ....your atty seem not that informed about waivers.

The hardships can only be on YOU they don't care about him...Its $585

each waiver and can take=is taking 6 - 14 mths these day.

U can always call NVC yourself and speak to them to know whats going

on, do not let the atty discourage U fro calling

OP waivers are paid for to the lockbox..no place else, NVC sends U a checklist

of whats needed photo, I 864, payments to aos, police record, disposition of case

(if he had one)....the atty in not being honest or are U using a notario?...U will

need to use the I 130 approval U received to enquire with the # starting with 3 letters then

some #s....do not tell him U will be calling them

Thank u so very much for everyone's responses...just talking to someone makes me feel better....now in response to all the documents mentioned, I have given every single one of them to our attorney...including all the letters...he has also told me about the $585 for each waiver but NEVER mentioned a Lockbox. My husband in Mexico is planning to pay that at the interview OR SO WE THOUGHT...I see now thru all your advice that that will not be the case...I don't understand why the lawyer didn't tell me this...what a heartbreaking blow this is knowing that we do in fact have yet so much time to wait....thank u everyone :-(

This is from the lawyer Laurel Scott.

"Processing times for waivers are currently inconsistent. I have I-601s being processed in less than five months and other ones taking more than eight months. There does not seem to be any rhyme or reason to the difference as some of my quickly-processed cases were more complex than the ones taking more time".

"It is NOT expected that I-601 processing times will continue to be processed in less than five months. As for I-601As, current processing times are holding steady at three to five months, but it is NOT expected that processing times will continue to be that short. This is the fastest I've ever seen average processing times for waiver cases in my ten year career. Just based on experience I cannot imagine average standard processing times remaining that short".
